Motion to Approve the On-Sale 3.2 Percent Malt Liquor License and an On-Sale Wine License including strong beer for Coffee House Holdings dba Starbucks #9652, the premise of which is located at 14903 S. Robert Trail subject to conditions. ISSUE An On-Sale 3.2 Percent Malt Liquor License and an On-Sale Wine License including strong beer application request has been made by Coffee House Holdings dba Starbucks #9652, located at 14903 S. Robert Trail. Starbucks will be beginning a remodeling project and will be expanding its menu to include more hot food options. They would like the opportunity to serve beer and wine with their expanded menu. City Code and State Statute allow for Starbucks to hold an on-sale wine license and on-sale 3.2% license if it is a restaurant and has seating for at least 25 people. With the upcoming expansion of their menu and kitchen, staff feels that Starbucks sufficiently meets the definition of restaurant. Starbucks has submitted the required liquor license application and background investigation fee. A background investigation was completed by the Police Department. Based upon the results of the investigation, police staff found no reason to deny the liquor license. Starbucks plans to have the remodel complete and expanded menu implemented sometime this spring. Chief of Police Scott recommends not issuing the license until the completion of the patio fence, due to the difficulty in monitoring the movement of drinks to the outside patio. City Code currently requires that Wine Licensees’ gross receipts be at least 51% attributable to sale of food. However, the requirement for Intoxicating Licenses allows for the inclusion of non-alcoholic beverages in that 51% minimum. Staff recommends amending the code to add non-alcoholic beverages in the wine license sales requirements, as stated in draft Ordinance 2016-01. There is no state requirement for a minimum sale of food, though it does require sales be made in conjunction with food. RECOMMENDATION Staff recommends approval of Ordinance 2016-01 Relating to Liquor Licenses; Amending Title 3, Chapter 1 of the Rosemount City Code and approval of the On-Sale 3.2 Percent Malt Liquor License and an On- Sale Wine License including strong beer for Coffee House Holdings dba Starbucks #9652, the premise of which is located at 14903 S. Robert Trail subject to following conditions as listed in resolution. CITY OF ROSEMOUNT COUNTY OF DAKOTA STATE OF MINNESOTA ORDINANCE NO. 2016 - 01 ORDINANCE RELATING TO LIQUOR LICENSES; AMENDING TITLE 3, CHAPTER 1 OF THE ROSEMOUNT CITY CODE THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS as follows: Section 1. Section 3-1-3-1 of the Rosemount City Code is amended as follows; B. On-Sale Wine Licenses: On-sale wine licenses shall be issued only to restaurants meeting the qualifications of Minnesota statutes, section 340A.404, subdivision 5, and whose total revenues are at least fifty one percent (51%) attributable to the sale of food and non-alcoholic beverages and shall permit only the sale of wine not exceeding twenty four percent (24%) alcohol by volume, for consumption on the licensed premises only, in conjunction with the sale of food. A holder of an on-sale wine license who is also licensed to sell 3.2 percent malt liquors at on-sale may sell intoxicating malt liquor at on-sale without an additional license. Section 2. CITY OF ROSEMOUNT RESOLUTION NO. 2016 - ____ A RESOLUTION APPROVING LIQUOR LICENSE FOR COFFEE HOUSE HOLDINGS, INC. DBA STARBUCKS #9652 WHEREAS, the City Council, pursuant to City Code Section 3-1-6 (B) held a public hearing on February 1, 2016, with respect to issuance of a liquor license for Coffee House Holdings dba Starbucks #9652, in connection with a restaurant located at 14903 South Robert Trail; and WHEREAS, the City Council has reviewed the application as it is on file with the City Clerk; and WHEREAS, the Chief of Police has reviewed the application as it is on file with the City Clerk; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount as follows: 1. To grant and approve a license for "On-Sale 3.2 Percent Malt Liquor" and "On-Sale Wine Licenses " to Coffee House Holdings dba Starbucks #9652, on premises located at 14903 Sout Robert Trail, in accordance with plans on file with the City, subject to: A. All terms and conditions of City Code Title 3, Chapter 1 as amended, and Minnesota Statute 340A. B. Patio area must be fully enclosed with a fence height of at least 42 inches and emergency exit gate. C. Approval of the Commissioner of Public Safety, as required by Minnesota Statute 340A.404 Subd. 5. D. The license shall not be effective until the renovations on the restaurant; including kitchen, seating area, and patio, are complete and conform to the premises described in the application approved by the Council, and the expanded menu has been implemented. E. Final inspection by City Clerk and/or Building Official. 2. The Mayor and City Clerk are hereby authorized to execute said license. 3. This license shall expire at 11:59 o'clock p.m., December 31, 2016. A renewal application must be received on or before November 1, 2016, pursuant to City Code Section 3-1-4-3.
