RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Drainage and Utility Easement over Outlot A, Bella Vista 3rd Addition.
SUMMARY
With the approval of the Final Plat for Bella Vista 3rd Addition, a drainage and utility easement was
recorded on the adjacent outlot on the northwest boundary of the 3rd Addition. To accommodate the
development of Bella Vista 4th Addition, a vacation of the drainage and utility easements of Outlot A, Bella
Vista 3rd Addition is necessary. This action is typical when there are multi-phased developments in a larger
preliminary plat. Appropriate new drainage and utility easements will be recorded with the Bella Vista 4th
Addition final plat.
RECOMMENDATION
Staff recommends approval of the drainage and utility easement vacation with the conditions listed within
the provided resolution.

RESOLUTION 2016 -
A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY
EASEMENTS OVER OUTLOT A, PRESTWICK PLACE 10TH ADDITION
WHEREAS, the City of Rosemount received an application from Lennar Corporation for the Final
Plat of Bella Vista 4th Addition;
WHEREAS, on March 15, 2016, the City of Rosemount City Council reviewed and approved the
Final Plat for Bella Vista 4th Addition; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is
required before the Final Plat can be recorded for Bella Vista 4th Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on March 15,
2016.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Vacation of the Drainage and Utility Easements, legally described as:
All drainage and utility easements lying over, under, and across Outlot A, BELLA VISTA
4TH ADDITION, according to the recorded plat thereof, Dakota County, Minnesota, as
delineated and dedicated on said plat of BELLA VISTA 3RD ADDITION.
subject to the recording of the Final Plat of Bella Vista 4th Addition.
ADOPTED this 15th day of March, 2016, by the City Council of the City of Rosemount.
