ATTACHMENTS: Location Map, Resolution, Drainage and Utility Easement Vacation Sketch APPROVED BY: ddj RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the Drainage and Utility Easement over Outlot C, Prestwick Place 2nd Addition. SUMMARY With the approval of the Final Plat for Prestwick Place 2nd Addition, a drainage and utility easement was recorded over all of Outlot C. This outlot was set aside for future development phases, and the eastern portion of Outlot C is the location of the proposed Prestwick Place 13th Addition final plat. To accommodate the development of Prestwick Place 13th Addition, a vacation of the drainage and utility easements over Outlot C, Prestwick Place 2nd Addition is necessary. This action is typical when there are multi-phased developments over a larger subdivision area. Appropriate new drainage and utility easements will be recorded with the Prestwick Place 13th Addition final plat. The vacation of an existing drainage and utility easement requires a public hearing, which has been continued to the September 6, 2016 City Council meeting. Proper notification and publishing have been done. RECOMMENDATION Staff recommends approval of the drainage and utility easement vacation with the condition listed within the attached resolution. SITE CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2016 - A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY EASEMENTS OVER OUTLOT C OF PRESTWICK PLACE 2ND ADDITION WHEREAS, the City of Rosemount received an application from Prestwick Place, LLC for the Final Plat of Prestwick Place 13th Addition; WHEREAS, on September 6, 2016, the City of Rosemount City Council reviewed and approved the Final Plat for Prestwick Place 13th Addition; and WHEREAS, the vacation of the existing drainage and utility easements legally described below is required before the Final Plat can be recorded for Prestwick Place 13th Addition; and WHEREAS, the City Council reviewed this request and conducted a public hearing on September 6, 2016. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easements, legally described as: All drainage and utility easements lying over, under, and across Outlot C, PRESTWICK PLACE 13TH ADDITION, according to the recorded plat thereof, Dakota County, Minnesota. subject to the recording of the Final Plat of Prestwick Place 13th Addition.
