Motion to adopt a resolution approving the revised Final Plat for Prestwick Place 13th Addition subject to conditions. SUMMARY The City Council is being asked to approve a revised Final Plat for Prestwick Place 13th Addition that dedicates additional right-of-way along County Road 73 (Akron Avenue). The proposed revision does not alter the arrangement or layout of any of the lots within the final plat. All of the new road dedication is occurring along the eastern edge of the plat adjacent to lots that were already platted with extra depth to account for the County road. Staff has reviewed the revised plat and found that it does not significantly alter the plat or plans previously approved by the City and is recommending approval as presented. DAKOTA COUNTY PLAT COMMISSION REVIEW Subsequent to the City of Rosemount’s approval of the Prestwick Place 13th Addition preliminary and final, the Dakota County Plat Commission reviewed the subdivision at its October 3, 2016 meeting. The Plat Commission review is required because the project abuts a County highway (TH73/Akron Avenue). As part of its review, the Commission noted that the County transportation plan specifies that Akron Avenue will be a four-lane divided road between 145th Street East and Bonaire Path East in Rosemount. To accommodate the space needed to construct such a road, the County requires a right-of-way of 150 feet in width, and therefore is asking that the developer dedicate a full 75 feet of right-of-way along the eastern edge of the Prestwick Place subdivision to dedicate land for one half of this roadway. The previous Prestwick Place additions have dedicated 55 feet of right-of-way so the 13th Addition must provide an additional 20 feet of right-of-way in order to meet the expanded dedication requirement. The developer has updated the final plat to accommodate the Plat Commission’s request by dedicating an additional 20 feet of right-of-way along the eastern edge of the plat. Because there is an existing retaining wall that would encroach into this right-of-way in the southeast portion of the subdivision, the County and developer have agreed to narrow the right-of-way in this specific area to nine feet. The developer would then provide a roadway easement over the remaining 11 feet to align with the rest of the right-of-way. By allowing an easement in this situation, the County will avoid any liability or maintenance responsibility for the wall while securing rights to use the property in the future if it is needed for expansion of the road. The Plat Commission is scheduled to take action on the revised final plat at its October 17, 2016 meeting. 2 CONCLUSION & RECOMMENDATION Staff is recommending approval of the revised Final Plat for Prestwick Place 13th Addition that dedicates additional right-of-way and easement along County Road 73 (Akron Avenue). CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2016 - A RESOLUTION APPROVING A REVISED FINAL PLAT FOR PRESTWICK PLACE 13th ADDITION WHEREAS, Prestwick, LLC, 350 Highway 7, Suite 125, Excelsior, MN (Applicant) has submitted an application to the City of Rosemount (City) for a revised Final Plat concerning property legally described as follows: Outlot C, PRESTWICK PLACE 2ND ADDITION, according to the recorded plat thereof, Dakota County, Minnesota WHEREAS, on August 23, 2016, the Planning Commission of the City of Rosemount reviewed the Final Plat for Prestwick Place 13th Addition; and WHEREAS, on August 23, 2016, the Planning Commission recommended approval of the Final Plat for Prestwick Place 13th Addition, subject to conditions; and WHEREAS, on September 6, 2016, the City Council of the City of Rosemount reviewed the Planning Commission’s recommendations and the Final Plat for Prestwick Place 13th Addition and approved the Final Plat with conditions; and WHEREAS, the Dakota County Plat Commission reviewed the Final Plat for Prestwick Place 13th Addition at its October 3, 2016 meeting and requested the dedication of additional right-of-way for County Road Number 73 (Akron Avenue); and WHEREAS, the Applicant revised the Final Plat to address the concerns of the Dakota County Plat Commission by dedicating an additional 20 feet of right-of-way (or right-of-way plus roadway easement) on the Final Plat; and WHEREAS, on October 18, 2016 City Council of the City of Rosemount reviewed the revised Final Plat for Prestwick Place 13th Addition. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the revised Final Plat for Prestwick Place 13th Addition, subject to the following conditions: 1. Execution of a Subdivision Agreement. 2. Drainage and utility easements with storm sewer infrastructure may contain fences but shall be required to include gates to provide truck access; shall prohibit sheds or other accessory structures; and shall prohibit landscaping that would impede drainage. 3. Conservation easements shall be recorded over all wetlands, wetland buffers, stormwater ponds and stormwater buffer strips. Fences are not allowed in the conservation easements. 4. Provision of $12,100 for landscaping security (44 trees x $250/tree x 110%). 5. Payment of $139,400 for Fee-in-Lieu of Park Dedication. 6. Compliance with the conditions and standards within the City Engineer’s Memorandum dated August 18, 2016. RESOLUTION 2016- 2 7. Construction of a temporary turn-around at the end of Ashford Path until such time that this road is extended into a future development phase. 8. The plat is adjacent to County State Aid Highway (CSAH) 73 (Akron Avenue), and is therefore subject to the Dakota County Contiguous Plat Ordinance. The proposed plat is a replat of Outlot C, PRESTWICK PLACE 2ND ADDITION, which includes 28 residential lots and one outlot. The right of way needs along CSAH 73 for a four-lane divided roadway are 75 feet of half right of way. The existing plat includes 55 feet of existing right of way along CSAH 73; therefore, the plat is required to dedicate an additional 20 feet. This is a change from when Prestwick Place 2nd Addition was platted – the plat needs were changed for CSAH 73 in 2013 from a 2-lane rural roadway section (55 feet of half right of way) to a four-lane divided roadway (75 feet). Restricted access is shown along all of CSAH 73. The Plat Commission has approved the preliminary plat provided that the described conditions are met. In addition, the developer, City and County will work together to determine the appropriate location of the right of way near the storm water detention pond and proposed retaining wall in the southeast corner of the site prior to submittal of a final plat. The Ordinance requires submittal of a final plat for review by the Plat Commission before a recommendation is made to the County Board of Commissioners. Traffic volumes on CSAH 73 are 2,550 ADT and are anticipated to be 20,000 ADT by the year 2030. These traffic volumes indicate that current Minnesota noise standards for residential units could be exceeded for the proposed plat. Residential developments along County highways commonly result in noise complaints. In order for noise levels from the highway to meet acceptable levels for adjacent residential units, substantial building setbacks, buffer areas, and other noise mitigation elements should be incorporated into this development. No work shall commence in the County right of way until a permit is obtained from the County Transportation Department and no permit will be issued until the plat has been filed with the County Recorder’s Office. The Plat Commission does not review or approve the actual engineering design of proposed accesses or other improvements to be made in the right of way. Nothing herein is intended to restrict or limit Dakota County’s rights with regards to Dakota County rights of way or property.
