Lot 9, Block 1 and Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, and 17, Block 2 of Evermoor 3' Addition (AKA Innisfree) from PO, Parks and Open Space to TR, Transitional Residential. 2. Outlot B, Bards Crossing, Outlot G, Evermoor 2 Addition (Shannon Park Elementary School) and Outlot C, Evermoor Clare Downs from TR, Transitional Residential to PO, Parks and Open Space. x uosEMOUN r CITY COUNCIL City Council Regular Meeting. December 20, 2005 EXECUTIVE SUMMARY SUMMARY These Comprehensive Plan Amendments were imtiated by staff to bring the future land use designation for the subject properties fisted below into comphance with the original Evermoor PUD design as well as the apphcable existing land uses and zoning designations. The subject properties and the proposed future land use designation changes are: 1. Lot 9, Block 1 and Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, and 17, Block 2 of Evermoor 3` Addition (AKA Innisfree) from PO, Parks and Open Space to IR, Transitional Residential (Change #1 on attached maps). 2. Outlot B, Bards Crossing, Outlot G, Evermoor 2 Addition (Shannon Park Elementary School) and Outlot C, Evermoor Clare Downs from IR, Transitional Residential to PO, Parks and Open Space (Changes #2, #3, and #4 on attached maps). These proposed changes represent "house keeping" items to bring the 2020 Comprehensive Plan Map into comphance with the ongmal Evermoor PUD design as well as the apphcable existing land uses and zoning designations for the given sites. For example, the Innisfree neighborhood sites contain detached townhomes and are guided PO, Parks and Open Space. In addition, the areas around Bards Crossing, Shannon Park Elementary School and the Clare Downs neighborhood contain permanent open space and are guided for TR, Transitional Residential It is important to note that the proposed land use designation will not alter the existing or intended use of these properties. In fact, these changes will ensure the Innisfree properties remain detached townhomes and the open spaces around Bards Crossing, Shannon Park Elementary School and the Clare Down neighborhood remain open space as mtended by the Evermoor PUD, the Zoning Ordinance and Comprehensive Plan. PLANNING COMMISSION ACTION The Planning Commission held a pubhc hearing for this item on November 22, 2005. Copies of the minutes from that meeting are attached for your reference After hearing no pubhc comment, the Commission voted unanimously to recommend that the City Council approve the amendments to the 2020 Comprehensive Guide Plan as outlmed above. CONCLUSION RECOMMENDATION Staff recommends approval of the 2020 Comprehensive Plan Amendments cited above. This recommendation is based on the findings that the current applicable future land use designations do not comply with existing or intend use of the given properties Re- guiding the future land use designation as outhned m this memo will not change the current or originally intended use of the subject properties. In fact, these changes will ensure these properties remain either townhomes (Inmsfree) or permanent open space (the areas around Bards Crossing, Shannon Park Elementary School, and the Clare Downs neighborhood) as originally intended by the Evermoor PUD and the Zoning Ordinance. 2 Draft Excerpt of Minutes from the Regular Planning Commission Meeting of November 22, 2005 Public Hearing: 5a. 05 -55 -CP Evermoor Comp Plan Amendment. Mr. Lindahl reviewed the staff report. The Comprehensive Plan Amendments were initiated by staff to bring the future land use designation for the subject properties listed below into compliance with the applicable existing land use and zoning designations The subject properties and the proposed future land use designation changes are: 1. Outlot 13, Bards Crossing, Oudot G, Evermoor 2 Addition (Shannon Park Elementary School) and Outlot C, Evermoor Clare Downs from TR, Transitional Residential to PO, Parks and Open Space (Changes #2, #3, and #4 on attached maps). Chairperson Messner asked the Commission for any additional follow -up comments or questions MOTION by Schwartz to recommend that the City Council approve 2020 Comprehensive Plan Amendments for Lot 9, Block 1 and Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, and 17, Block 2 of Evermoor 3` Addition (AKA Innisfree) from PO, Parks and Open Space to TR, Transitional Residential. Second by Zurn. Ayes. All. Nayes None Motion approved. Motion carried t CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2005- A RESOLUTION APPROVING THE COMPREHENSIVE GUIDE PLAN AMENDMENT TO EVERMOOR INNISFREE PROPERTIES AND PARKS AREAS LOCATED IN THE EVERMOOR DEVELOPMENT WHEREAS, the Community Development Department of the City of Rosemount requested a Comprehensive Guide Plan Amendment to reguide the properties located in Evermoor Inmsfree Development and Park Areas in the Evermoor Development to bring the future land use designations into compliance with the original Evermoor PUD design and applicable existing zoning designations. WHEREAS, on November 22, 2005, the Planning Commission of the City of Rosemount held a public hearing to receive public comment on the Comprehensive Guide Plan Amendment changing the land uses from PO Parks and Open Space to TR, Transitional Residential in the Evermoor Inmsfree Addition and from TR Transitional Residential to PO. Parks and Open Spaces in Outlot B, Bards Crossing, Outlot G, Evermoor 2nd Addition (Shannon Park Elementary School) and Outlot C, Evermoor Clare Downs; and WHEREAS, the Planning Commission adopted a motion to recommend that the City Council approve the Comprehensive Plan Amendments for Lot 9, Block 1 and Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, and 17, Block 2 of Es ermoor 3rd Addition (AKA Inmsfree) from PO, Parks and Open Space to TR, Transitional Residential and Comprehensive Plan Amendments for Outlot B, Bards Crossing, Outlot G, Evermoor 2nd Addition (Shannon Park Elementary School) and Outlot C, Evermoor Clare Downs from 'TR, Transitional Residential to PO, Parks and Open Space; and WHEREAS, on December 20, 2005, the City Council of the City of Rosemount reviewed the Planning Commission's recommendation and the Comprehensive Guide Plan Amendments reguiding the properties in the Evermoor Developments. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Comprehensive Guide Plan Amendment reguiding the property in the Evermoor Developments as outlined above and illustrated on Exhibit A (attached) subject to Metropolitan Council approval.
