EXECUTIVE SUMMARY
ISSUE
Council is requested to consider an application for a new on -sale liquor license at 3400 150 Street West, Suite B,
which is located facing County Road 42 m a portion of the property formerly known as Knowlan's Supermarket in
Rosemount Market Square.
BACKGROUND
Carl Morgan, LLC has submitted an application for an on -sale liquor license. Owners and managers of Fox's Pizza,
Robert and Kathleen Johnson, propose a new restaurant to be run jointly with their Fox's Pizza franchise. A PUD
Minor Amendment is required for the change m land use from retail to restaurant at Rosemount Market Square.
City Planner Pearson has prepared the amendment for consideration on the Consent Agenda this evening, Item 6. i.
Walleye's Bar Grill is a full- service restaurant. The menu will be chef -driven and include steak, ribs, smoked pork
and seafood. Walleye will be the only fresh -water fish on the menu, but will not be the dominant menu theme.
There will be a bar near the entrance that seats about eight customers. There will be approximately 2,000 sq. ft.
available for seating, including the bar The entire restaurant has 6,038 sq. ft. There is no outdoor seating
proposed. The interior decor will be remuuscent of a rustic north woods cabin.
City Planner Pearson conducted a thorough parkrig study and recommended the PUD Minor Amendment for
Rosemount Market Square be approved. This will result in a required major amendment to Rosemount Market
Square in the event they would request an expansion m the future. Mr Pearson noted that Walleye's has an
exclusivity feature in their lease that will restrict additional restaurants.
On -Sale liquor hcenses held at restaurants are not limited by City ordinance of State law. All fees and proof of
msurance have been received.
Pohce Lt. Dwayne Kuhns conducted a full investigation on the apphcant and manager, Robert Johnson and his
wife, Kathleen Johnson. No criminal record was found.
SUMMARY
Staff finds no reason to withhold the on -sale liquor license. The recommendation is to approve the license with the
above motion.

Subject: Background Investigation Walleye's Bar Grill
I was requested to conduct a background investigation regarding the issuance of a liquor license to
Walleye's Bar Gnll/Fox's Pizza, the following is a summary of that investigation.
Carl Morgan, LLC. is the parent company of Walleye's Bar Grill. Fox's Pizza is a national
franchise and not a holding of Carl Morgan, LLC. The corporate officers for Carl Morgan, LLC. are
Robert and Kathleen Johnson. Robert Johnson is also named as the store manager. The Johnson's
have operated the Fox's Pizza franchise located at 15092 Claret Avenue, Rosemount, for
approximately two (2) years There have only been three (3) calls for service at that restaurant and
none of the calls indicate a cause for concern
The license applicants did provide certificate of liability insurance, which was issued by the ARGES
Group, Inc. of St. Paul This certificate covers Workers Compensation and Liquor Liability.
Criminal Background checks were conducted on all apphcants. No cnmmal record was found on
any of the apphcants. Local records checks m both Burnsville and St. Cloud also indicate no
contacts.
Contact was also made with the apphcant's references, Thomas Glynn and Brian Gleason both who
indicated no cause for concern regarding the issuance of a liquor license to the applicants and feel
that Mr Johnson restaurant would be a good addition to any community.
