Robert Tr., and, the Charitable Gambling Premises Permit for the VFW Post 9433 Rosemount, 2625 120 St. W 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: November 15, 2005 EXECUTIVE SUMMARY ISSUE Council tabled this request at the regular November 1 City Council meeting. BACKGROUND Charitable gambling is controlled by Minnesota Alcohol and Gambling Enforcement. Rosemount City Council's approval is necessary for Baseball Association #191 and the VFW to proceed with their applications to the State This would allow chartable gambling pull-tabs at Shenanigans Pub and McDmot's Sports Pub and Eatery; with Baseball Association #191; and, the Rosemount VFW who manages their own charitable gambling 1. Shenanigans Pub, located at 14605 South Robert Trail, has leased space to the Baseball Association #191 for charitable gambling since 2004 for pull-tabs Their premises permit was approved through March 31, 2006; however, it must run concurrent with Baseball Assoctauon #191's permit with the State Gambling Board, which expires December 31, 2005. Renewing this gambling premises permit now will allow the lease permit and gambling premises permit to coincide. The gambling prenuses permit term is January 1, 2006 to December 31, 2008. 2. Bill Schneider from McDivot's has noticed the MLBA Children's Fund that they will be canceling their agreement within the 30 -day lease contract requirement Mr. Schneider indicated he was not satisfied with 1\1LBA's allocation of funds and expects more funds to be directed to the Rosemount High School with the change of organization to Baseball Association #191. The gambling premises permit term is January 1, 2006 to December 31, 2008 3. VFW Post 9433 in Rosemount, located at 2625 120th Street West, is renewing their gambling premises permit on a normal schedule This will allow the State time to process the permit which expires February 28, 2006. The gambling premises permit term is March 1, 2006 to February 28, 2008 A premises permit term is for two years. The charitable gambling ordinance requires 80% of the annual lawful purpose expenditures within the city's trade area. The Police Department investigated the gambling managers and found everything in order SUMMARY City Administrator Verbrugge and Mayor Droste met with officials from the Baseball Association #191 to satisfy questions regarding donations within the Rosemount trade area The meeting produced information showing 91% of available funds were donated in the Rosemount trade area Mr. Verbrugge and Mayor Droste recommend moving forward with the request Staff has reviewed the application, donation allocations, and finds no reason to deny the Charitable Gambling Premises pentiits CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2005 A RESOLUTION APPROVING A CHARITABLE GAMBLING PREMISES PERMIT FOR BASEBALL ASSOCIATION #191 at SHENANIGANS PUB, 14605 SOUTH ROBERT TRAIL AND McDIVOT'S SPORTS PUB AND EATERY, 14550 SOUTH ROBERT TRAIL WHEREAS, the Baseball Association #191 Gambling Manager Richard D. VanderLaan has approached the City of Rosemount to qualify for charitable gambling at Shenanigans Pub after December 31, 2005 for a two year permit that coincides with Baseball Association #191 state gambling license. WHEREAS, the Baseball Association #191 Gambling Manager Richard D. VanderLaan has approached the City of Rosemount to qualify for charitable gambling at McDivot's Sports Pub and Eatery after December 31, 2005 for a two year permit that coincides with Baseball Association #191 state gambling hcense. WHEREAS, the MLBA Charitable Children's Fund has been noticed that they will no longer be operating the charitable gambling at McDivot's Sports Pub and Eatery after December 31, 2005, and WHEREAS, this is a renewal gambling premises permit for Shenanigans Pub and they are satisfied with the Baseball Association #191 management of pull -tabs. WHEREAS, Baseball Association #191 has produced reporting forms showing that 91% of the lawful purpose expenditures are within the City's trade area. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount, Dakota County, Minnesota, hereby approves the Baseball Association #191 Gambling Premises Permits to conduct chantable gambling m Rosemount at:: Busines s /Address Term A. Shenanigans Pub at 14605 South Robert Trail; and Jan. 1, 2006 to Dec. 31, 2008 B. WHEREAS, this is a renewal gambling premises permit request for the VFW Post 9433 Rosemount for the management of pull-tabs WHEREAS, the VFW has produced reporting forms showing that 83% of the lawful purpose expenditures are within the City's trade area.
