EXECUTIVE SUMMARY
BACKGROUND
This item was imitated by staff to update Section 8 Off Street Parking and Loading. After updating the
C -3 and C -4 Distncts, staff noticed three minor changes were needed to insure consistency between the
new C -3 and C -4 standards and Section 8 of the Zoning Ordinance related to the three areas listed below.
Parking and Storing of Trucks. The C -2, Downtown Commercial, C -3, Highway Commercial, and C -4,
General Commercial Distracts all contain an accessory use allowing Outdoor Sales and Display of
Merchandise with a condition related to the parking and storing of trucks All three sections are identical.
In an effort to eliminate redundancy within the Zoning Ordinance, staff recommends striking it from the
C -3 and C -4 Districts and relocated this standard to Section 8.1 D Limitations on Use. In this location,
the standard will apply to the enure City lather than lust the C -2, C -3, and C -4 Distracts Staff plans to
update the C -2 Distract in the near future and will delete the standard m that section of the ordinance at
that tune.
Parking Requirements. Section 8 1.H contains off street parking requirements for Business Uses. The
standards for car washes, drive through restaurants, banks, and gasoline stations also include requirements
for stacking spaces. As a result of modernizing the C -3 and C -4 Districts, staff created specific conditional
use standards for each of these uses which include requirements for stacking spaces. To eliminate
redundancy and potential conflicts with the revised C -3 and C -4 Districts, staff is stnking out the stacking
references for car washes, drive through restaurants, banks, and gasoline stations contained in Secuon
8.1 D
General Standards for Car Washes, Drive Through Restaurants, Banks and Gasoline Stations.
Section 8 1 1 contains general standards for Drive Though hiciltties related to circulation and stacking
spaces. Staff modified the terminology m this section to match the amended C -3 and C -4 Districts as well
as added a reference to the conditional use permit standards for these uses m the C -3 and C -4 Districts.
PLANNING COMMISSION ACTION
The Planning Commission held a pubhc hearing to review this item on October 25, 2005. After hearing a
presentation from staff, the Commission opened a public hearing After hearing no comments from the
pubhc the hearing was closed. With no comments from the Commissioners, the Planning Commission
voted unanimously to recommend that the City Council adopt an ordinance amending Section 8 1 D
(Limitations on Use) Section 8.1.H (Off Street Parking) and Section 8 1.I (Drive Through Facilities for
Restaurants, Banks, and Other Similar Uses) to insure consistency between these sections and the
amended C -3 and C -4 Districts.
CONCLUSION AND RECOMMENDATION
This item was mttiated by staff to update Secuon 8 Off Street Parking, Loading and Landscaping. After
updating the C -3 and C -4 Distracts, staff observed three minor changes were necessary to insure
consistency between the new C -3 and C -4 standards and Section 8 of the Zoning Ordinance These areas
are outhned above. Staff recommends approval of these amendments based on the findings that they will
insure consistency and eliminate redundancy between the amended C -3 and C -4 Districts and Section 8
related to off street parlung and loading

AN ORDINANCE AMENDING SECTION 8 OF THE CITY OF ROSEMOUNT ZONING
ORDINANCE B RELATING TO OFF STREET PARKING, LOADING AND
LANDSCAPING
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS that
Ordinance B, adopted September 19, 1989, entitled "City of Rosemount Zoning
Ordinance," is hereby amended as follows.
Section 1. Rosemount Zoning Ordinance B, Section 8 is hereby amended as
follows:
1. No commercial repair work or service of any kind, or sale or display thereof,
or the storage of new or used vehicles which are not for the use of the
occupant, employees and patrons shall be conducted in such parking area.
2. Off street parking once designated as required off street parking shall not be
changed to any other use until equal facilities as required by this Code are
provided elsewhere.
3. Off street parking existing at the date of adoption of this Ordinance in
connection with the operation of an existing building or use shall not be
reduced to an amount less than hereinafter required for a similar new building
or use.
4. Except while loading unloading, or rendering a service in a designated
loading area, no commercial trucks, truck tractor, or semi trailer combinations
shall be parked and /or stored longer than twenty (24) hours. Semi trailers
may not be used for outdoor sales storage or display.

8.1.1. Drive Through Facilities for Restaurants,
Banks, and Other Similar Uses Stacking Spaces Required:
1. Circulation: No stacking space shall encroach into any drive aisle
necessary for the circulation of vehicles on the lot.
2. Setbacks Required: All stacking shall comply with the setbacks required
for parking spaces.
3. Size of Stacking Spaces. The minimum size of stacking spaces shall be
nine feet by eighteen feet (9' X 18').

4. All Drive Through Facilities for Restaurants, Banks and Other Similar
Uses shall conform to the standards listed above, the applicable
conditional use permit standards outlined in Sections 6.13 (the C -3
Highway Commercial District) and Section 6 14 (the C -4 General
Commercial District), as well as the applicable section of Ordinance B.
Section 2, EFFECTIVE DATE. This Ordinance shall be in full force and
effect from and after its passage and publication according to law.

Mr. Lindahl reviewed the staff report. This item was initiated by staff to update Section 8
Off -Street Parking and Loading. After updating the C-3 and C -4 Distracts, staff noticed
three minor changes where needed to insure consistency between the new C -3 and C -4
standards and Secuon 8 of the Zoning Ordinance related parking and storing of trucks,
parking requirements, general standards for car washes, dnve through restaurants, banks and
gasoline stations.
Chairperson Messner asked the Commission if they had any questions for Mr. Lindahl.
There were no questions for Mr. Lindahl.
Chairperson Messner opened the Public Hearing. There was no public comment.
MOTION by Schwartz to close the Public Hearing. Second by Zum. Ayes: All.
Nayes: None. Motion approved.
MOTION by Zurn to recommend to recommend the City Council adopt an
ordinance amending Section 8.1.D (Limitations on Use) Section 8 1.H (Off -Street
Parking) and Section 8.1.I (Drive Through Facilities for Restaurants, Banks, and
Other Similar Uses) to insure consistency between these sections and the amended
C -3 and C -4 Distracts.
