Brotzler, P.E., City Enginee r AGENIj i;j,` APPROVED 4 2 A BY: ATTACHMENTS: 1) Petition for Local Improvements 2) Petition Against Local Improvements; 3) Exhibit; 4) Summary of Individual Septic Treatment System Status; 5) Sign up sheet for August 17, 2005 Public Informational Meeting; 6) Informational Handout; 7) Letter from Mr. Mrs. Krogh RECOMMENDED ACTION: For Discussion 4 ROSE MOUNT CITY COUNCIL City Council Work Session: September 14, 2005 EXECUTIVE SUMMARY BACKGROUND: As part of the County Road 38 Phase I project development, Staff conducted a public informational meeting m January 2004 for property owners along 132 Court to determine the level of interest in having pubhc utilities installed as part of the County Road 38 Phase I Improvements Based on the input received in opposition to the extension of public utilities, no action was taken by Council to proceed with the consideration of extending public utilities to 132 Court Recently, Staff was contacted by a property owner interested m having public utilmes extended to 132 Court. This property owner is one of several property owners that have a non compliant individual septic treatment system (ISTS) On August 17, 2005, Staff hosted a second public informational meeting for property owners along 132 Court At this meeting, Staff presented information on estimated project costs and connection charges for the completion of a project in conjunction with the County Road 38 Phase I Improvement project. It was noted that the estimated costs as presented were based on completing a project for 132 Court as part of the County Road 38 Phase I Improvement project and that the estimated costs would be higher if a separate project was completed later A petition in opposition to pubhc improvements was received by Staff at this meeting and is attached. Also attached is a copy of the sign up sheet and information that was distributed at the pubhc informational meeting On August 24, 2005, Staff received a petition for local Improvements, a copy of which is attached Following the receipt of this petition, Staff in the Building Division prepared a summary sheet of the status of all of the ISTS's along 132 Court. This summary and the attached exhibit show the status of the existing ISTS's along with the properues represented on the two petitions SUMMARY: At this time, Staff is seeking Council direction on how to proceed with this item. Should Council choose to proceed with a project, it would be appropriate for Council to receive the petition for local improvements and authorize the preparation of a feasibility report. All plumbing fixtures and drains used to receive or discharge liquid wastes or sewage shall be connected to the drainage system of the building in accordance with the requirements of the code. (4715.1200) WATER REQUIRED. Only potable water shall be assessable to plumbing fixtures supplying water for drinking, bathing, culinary use, or the processing of food, medical, or pharmaceutical products. (4715.1700) IDENTIFICATION METHODS. In all buildings where dual water distribution systems, one potable water and other nonpotable water, are installed, each system shall be identified, either by color marking or metal tag. (4715 1910, Subpart 1) COLOR MARKING. Potable water Imes should be painted green and non potable lines should be painted yellow. (4715.1910, Subpart 2) CROSS CONNECTION CONTROL. Cross- connections between potable water systems and other systems or equipment containing water or other substances of unknown or questionable safety are prohibited. Cross connections between an individual water supply and a potable public supply shall not be made unless specifically approved by the authority having lunsdiction. This is a follow up from the meeting August 17, 2005 at City Hall. Several people were interested in the proposal and the cost. The figures are very costly and staggering. The total cost of the project could range between 522,000- $30,000 per resident. We have two residents out of compliance while the other residents are in compliance, thus making the project not necessary to proceed. The two residence that are not in compliance can be brought up to compliance with many dollars saved by them and other residence who are compliant. Many of the residence have spent many dollars already to stay compliant as, should the two residence who are out of compliance. Resident at 2655 has a mound system that will Last indefinite. Due to great friendship. teaming with the resident at 2625 who is not in compliance, are now canvasing for the sewer. Yes, even cities have problems with sewer lines. Having city sewer and water does not make for a perfect system for ever. We still want to drink our water which is much better tasting than city treated water. Allowing only for out side use of our current wells is not a fair practice regardless of the reasons given by the city. If a petition once again is brought to the residence, this should be generated by the city and not just a few residences of 132nd Ct. W. This project has divided the longevity of a stable neighborhood. At an earlier meeting, we were told residence on Cty. Rd 38, had to hook up and now at the last meeting told they could vote. What is it? Too many variables and questions left unanswered. It is in the best interest of the residents of 132nd Ct. W to eliminate this project and have the non compliant systems updated like the remainder of the court has already done. Respec fully, "iorrest ate ern rogh 132nd, Ct.
