EXECUTIVE SUMMARY
BACKGROUND
The City Council has recently discussed issues related to the current Off -Sale Intoxicating Liquor Licenses
Ordinance at work sessions on September 20 and October 12. Staff has been directed to prepare an
ordinance amendment for Council consideration that would increase the number of off -sale liquor licenses
currently available and eventually eliminate the limit on off -sale licenses.
ISSUE
Rosemount City Code Title 3: Liquor Regulations, Section 3 -1 -2 L., currently limits the number of off -sale
liquor licenses to 1 per 6,500 population attained, as determined by the most recent Metropolitan Council
population estimates. The most recent Metropolitan Council estimate of Rosemount population is 17,740,
meaning that two hcenses may be issued. Both licenses have been issued. Based on the timing of the
Metropolitan Council's release of population estimates, the earnest that a third license would be available is
April or May of 2006. That would mean a one -year increase in population of nearly 1,800 residents, which
staff does not anticipate based on our knowledge of the Met Council's estimate methodology. The more
likely scenario is that the current ordinance language would prohibit a third license or more unul mid -2007.
Council review of this ordinance has considered a number of issues, including: the regulatory approach of
neighboring and like -sized communities in regard to off -sale liquor licensing; the basis for determining
population estimates as they pertain to a per license ratio; the public interest in regulating and controlling
the sale and distribution of alcohol; and economic development impacts to the community
The Council discussion has also benefited from the input of interested parties. Both current license
holders have spoken in favor of maintaining the ordmance language as it currently exists. Several
prospective off -sale liquor business representatives interested m Rosemount have voiced support for an
ordinance amendment.
The proposed ordinance amendment would eliminate the correlation of the number of licenses to any
population estimate and proposes a set limit of four (4) licenses. Although most of the other communities
surveyed do not restrict the number of licenses, the market of stores per population averages about
1:5,000 The current staff estimate of population is 20,300, which would follow the market average of
1:5,000 persons with a limit of 4 licenses. However, the Council direction was to ultimately eliminate a
specific limit on licenses. The proposed ordinance would not limit the number of licenses after June 30,
2007.

SUMMARY
This is the first reading of the proposed ordnance amendment. Unless otherwise directed, this item will
be placed on the November 15, 2005 Regular City Council Agenda for second reading and adoption. The
amended ordinance will be effective following publication in the official paper of record.
One other item related to this issue was direction by Council to establish cntena by which multiple
applications may be weighed when a limited number of hcenses are available. Staff will review proposed
criteria with the City Council at the November work session prior to second reading of the ordinance.

AMENDING ROSEMOUNT CITY CODE
TITLE 3: LIQUOR REGULATIONS
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS
FOLLOWS:
Section 1. Rosemount Qty Code Section 3 -1 -2 paragraph L.2. is amended as follows:
L. Apportionment of Intoxicating Liquor Licenses.
Section 2. This Ordinance shall be effective immediately upon its passage and publication.
ADOPTED by the City Council of the City of Rosemount, Minnesota the day of
2005.
