ACTION: City Council Meeting Date: May 17, 2005 CITY OF ROSEMOUNT EXECUTIVE SUMMARY FOR ACTION ISSUE The purpose of this ordinance is to bring the Zoning Ordinance, Building Code and Fire Code into accord relating to requirements for building address number display, therefore facilitating emergency response. BACKGROUND Code enforcement staff was asked to assist the Police Department with increased enforcement of the requirements for display of building address numbers. There had been a noticeable increase in properties that officers were having difficulty locating due to a missing or improperly displayed building address numbers. SUMMARY In preparing written material for this effort staff discovered that the zoning ordinance, building code, and fire code requirements for the display of building address numbers were not in accord. The ordinance affects the zoning ordinance, bringing it into compliance with building and fire code requirements. A public hearing was held at the Planning Commission for the text amendment and there was no public testimony given. The Commission unanimously recommended approval of the change. Because zoning ordinance amendments require a public hearing at the planning commission and the amendment is published and affected property owners noticed, staff does not typically propose holding a first reading with adoption at a later date For this reason, staff is recommending approval of the ordinance as written. RECOMMENDATION Adopt the draft ordinance 10.2: PERMITTED SIGNS: CITY OF ROSEMOUNT STATE OF MINNESOTA ORDINANCE NO. B- AN ORDINANCE PERTAINING TO THE DISPLAY OF BUILDING ADDRESS NUMBERS ON STRUCTURES WITHIN THE CITY The display of building address numbers as required by the Rosemount Zoning Ordinance is a matter of critical importance to Police, Fire and Emergency Medical Services responders who may be called upon to provide service in times of emergency. The location and visibility of the building address numbers in a way that enhances the speed of this response is paramount. The building address numbers displayed as required also provide identification of the premise for the Postal Service, delivery services, and fancily or guests attempting to locate a residence. The Rosemount Zoning Ordinance and the currently adopted International Fire Code (2002 version) conflict in the requirements for display of building address numbers. This amendment will bring the two codes into accord. THE COUNCIL OF THE CITY OF ROSEMOUNT ORDAINS AS FOLLOWS: Section 1. Section 10.1:C, 11 and 10.2:A, 9 of the Rosemount Zoning Ordinance are amended as follows. 10: SIGNS: 10.1: PURPOSE, DEFINITIONS, GENERAL PROVISIONS: C. General Provisions: Address numbers. New and existing buildings shall have building address numbers placed in a position to be plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numerals. Numbers shall be a minimum of four (4) inches high with a minimum stroke width of one half (1/2) inch. These numbers shall be affixed to the principal structure, except in non sewered areas where address numbers shall be affixed to mailboxes or a separate structure plainly legible and visible from the street or road fronting the access to the property. A. All Districts: The following signs are allowed without a permit in all zoning districts, but shall comply with all other applicable provisions of the ordinance. 9. Address Signs: Signs displaying letters or numbers (meeting the requirements of 10.1.C, 11) naming only the owners and /or address of the property not exceeding one four square foo feet located at the street frontage property line, except on corner lots where such signs shall be set back at least fifteen feet (15') from either property line on the principal structure. Address signs allowed under this subsection will be allowed in addition to the required address numbers displayed on principal structures in sewered areas but shall not be substituted for the address numbers required by 10.1:C, 11. Excerpt from the Regular Planning Commission Meeting of April 26, 2005 Public Hearing: 5C. Case 05 -13 -TA Requirement of Building Address Numbers Zoning Text Amendment. Code Enforcement Official O'Brien reviewed the staff report. Code Enforcement staff was asked to assist the Police and Fire Departments with increased enforcement of the requirements for the display of building address numbers. There had been a noticeable increase in properties that officers were having difficulty locating due to a missing or improperly displayed building address numbers. Chairperson Messner asked the Commission for any questions for Mr. O'Brien. Commissioner Zurn questioned if this ordinance requires existing residents to change their address numbers Mr. O'Brien stated this ordinance will only affect those properties he receives complaints on or homes that have no numbers at all. Commissioner Powell asked if there is an increase of problems in the older or new properties Mr. O'Brien stated that comments he received from the Police and Fire Departments include the older homes where numbers are faded or trees shade the numbers. Chairperson Messner questioned how long new construction homes have to display the numbers. Mr. O'Brien stated the plan is to address the issue upon passage of a building permit. Chairperson Messner opened the Public Hearing. There were no public comments. MOTION by Humphrey to close the Public Hearing. Second by Zum. Ayes: Schultz, Zum, Messner, Humphrey and Powell. Nayes: None. Motion carried. Chairperson Messner asked for any follow -up questions or discussion. MOTION by Humphrey to recommend that the City Council approve the zoning ordinance text amendment relating to address numbers on structures. Second by Zum. Ayes: Schultz, Zurn, Messner, Humphrey and Powell. Nayes: None. Motion approved.
