Aina Wiklund is donating part of her land for public use as permanent open space with a conservation easement Parcel A will contain Ms. Wiklund's residence and Parcel B will be donated to the City for open space Payment for the conservation easement was made possible with grant money from the Minnesota Department of Natural Resources, Dakota County and the City of Rosemount. PLANNING COMMISSION PUBLIC HEARING On April 26, 2005, the Planning Commission conducted a public hearing as required. No one in attendance provided comment. One Commissioner asked if the City was paying for the conservation easement Staff explained that the easement was paid for through a combination of City, State and County funds. SUMMARY The lot split will divide the Wiklund property into two parcels so that one of them can be donated to the City for open space preservation Both parcels will be covered by the conservation easement although the remaining 10.15 acres will continue to be the residence of Ms Wiklund Both parcels created by the split exceed the lot requirements for the Agriculture and Rural Residential zoning districts The property is currently zoned Agriculture, although it is guided for Rural Residential use The rural residential zoning district has standards that reflect higher density development than Agriculture, but the lot standards are similar. There are only two platted subdivisions in the Agriculture district, including the recently approved Flint Hills Estates. Rezoning of the Wiklund property is not requested at this time Rezoning would be required if the lot split was to create a buildable parcel on Parcel B for residential use. Parcel B will be covered with a permanent conservation easement which means the property will be preserved in its natural state for perpetuity. The City Council may recall a related lot split concerning the Bester property that separated the Wiklund property from Bacardi Ave That split was approved and the eastern property purchased by the City As a result Parcel "C as shown on the survey, functions as expanded street right -of -way solving the lot access problem previously affecting the Wiklund property. While this is a subdivision, it is not being done to facilitate new residential, commercial or industrial uses. Therefore, there are no applicable development fees or other typical requirements or recommended conditions of approval. N/A 2 AND PARCEL A PARCEL B CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2005 A RESOLUTION APPROVING THE CITY OF ROSEMOUNT LOT SPLIT REQUEST FROM AINA WIKLUND TO ACQUIRE PARCEL 13 OF 12110 BACARDI AVE. WHEREAS, the Community Development Department of the City of Rosemount received an application from the City of Rosemount Parks and Recreation Department on March 21, 2005 requesting a Lot Split for the property located at 12110 Bacardi Ave., legally described as: LEGAL DESCPRIPTION OF THE ENTIRE PARCEL THE SOUTH 50 RODS (825 00 FEET) OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 16, TOWNSHIP 115, RANGE 19, DAKOTA COUNTY, MINNESOTA. THAT PART OF THE NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 16, TOWNSHIP 115, RANGE 19, DAKOTA COUNTY, MINNESOTA. THAT PART OF THE SOUTH 825.00 FEET OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 16, TOWNSHIP 115, RANGE 19, DAKOTA COUNTY, MINNESOTA, LYING NORTH OF THE SOUTH 491.32 FEET THEREOF. THE SOUTH 491.32 FEET OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 16, TOWNSHIP 115, RANGE 19, DAKOTA COUNTY, MINNESOTA. WHEREAS, on April 26, 2005, the Planning Commission of the City of Rosemount held a public hearing to review the Lot Split located at 12110 Bacardi Ave.; and WHEREAS, the Planning Commission adopted a motion to recommend that the City Council approve the Lot Split for the property located at 12110 Bacardi Ave and WHEREAS, on May 17, 2005, the City Council of the City of Rosemount reviewed the Planning Commission's recommendation and the Lot Split requested for 12110 Bacardi Ave. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Lot Split request from the City of Rosemount Parks and Recreation Department for 12110 Bacardi Ave. ADOPTED this seventeenth day of May, 2005 by the City Council of the City of Rosemount. Case 05 -14 -LS City of Rosemount Lot Split (Wiklund Property). City Planner Pearson reviewed the staff report. The requested lot split is part of the process to facilitate the preservation of open space. Aina Wiklund is donating part of her land for public use as permanent open space with a conservation easement. Parcel A will contain Ms. Wiklund's residence and Parcel B will be donated to the City for open space. Chairperson Messner asked the Commission if they had any questions for Mr. Pearson. Commissioner Powell questioned since the property is donated will the City be paying for the easement. Mr. Pearson stated payment for the conservation easement was made possible with grant money from the Minnesota Department of Natural Resources, Dakota County and the City of Rosemount Chairperson Messner opened the Public Hearing. There was no public comment. MOTION by Humphrey to close the Public Hearing. Second by Powell. Ayes: Schultz, Zurn, Messner, Humphrey and Powell. Nayes: None. Motion carried. Chairperson Messner asked for any follow -up questions or discussion. MOTION by Zurn to recommend that the City Council approve the lot split request for the Wiklund property at 12110 Bacardi Ave. Second by Schultz. Ayes: Schultz, Zum, Messner, Humphrey and Powell. Noyes: None. Motion approved.
