Assistant City Planner AG oI. b ATTACHMENTS: Draft Driveway Setbacks Ordinance, Site Plan Illustrating New Setbacks, Draft 08/23/05 PC Minutes APPROVED BY: fii RECOMMENDED ACTION: Motion to adopt an ordinance amending section 7.2.0 6.d (Supplemental Yard Regulations) reducing the street side yard setbacks for driveways on corner lots from sixty (60) feet to the greater of the applicable frontyard setback or the required sight triangle. 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: September 20, 2005 EXECUTIVE SUMMARY BACKGROUND This text amendment was initiated by staff after determining that the current dnveway setback standards could not be implemented on certain lots withm the City. The current standard requires a 60 foot setback from the street side yard property hne on a comer lot. However, some properties within Rosemount do not have sufficient width to accommodate the required sixty foot setback plus the 22 foot driveway plus the required five foot setback from the interior lot line (totaling 87 feet) Wlule this standard would work for a standard 90 foot corner lot, it may proved problematic for lots m the older parts of town (R-1A Distract) as well as some of the new "traditional' lots, such as those platted in Glendalough. The proposed standard would reduce the required street side setback for driveways on corner lot from sixty (60) feet to the greater of the apphcable front yard setback or the required sight triangle (see attached example). This change is acceptable to the Engineering Department who often deals with sight triangle issues. PLANNING COMMISSSION ACTION The Planning Commission held a public hearing to review this item on August 23, 2005 (minutes from this meeting are attached for your reference). After hearing no pubhc comment, the Commission discussed this item and had questions for staff. Chairperson Messner stated he feels this amendment would allow driveways too close to busy intersections like those of collector streets. Staff responded that while this text amendment will allow driveways closer to intersections, both the Engineering and Planning Departments feel that there still is sufficient area for safe maneuvering and the sight triangle. CONCLUSION AND RECOMMENDATION While the spirt and intent of this regulation is to maintain clear sight lines through intersections, staff feels that reducing the driveway setback on street side yards to the greater of the applicable front yard setback or the required sight triangle will maintain safety while offering greater flexibility to residents. Therefore, staff recommends approval of this text amendment AN ORDINANCE AMENDING THE ZONING REGULATIONS PERTAINING TO SUPPLEMENTAL YARD REGULATIONS THE COUNCIL OF THE CITY OF ROSEMOUNT ORDAINS AS FOLLOWS: Section 1. Section 7.2.C.6.d of the Rosemount Zoning Ordinance is amended as follows: d. Driveways: special regulations. In commercial, business park, industrial, multi family residential and single family developments, site plans or plats. No driveway from private property serving a commercial, business park, industrial, multi family residential or single family attached residential use entering a public or private street shall be less than 24 feet nor more than 36 feet in width (not including medians). One -way driveways shall be no less than 12 feet wide. Single family- detached Residential driveways are subject to the following requirements when connecting to and within at the street right -of -way: (1) Maximum Width. They shall not exceed 22 feet in width (curb cut radii excluded). (2) Encroachment. Curb cut radii shall not encroach upon the boulevard of abutting properties. (3) Number of curb cuts. Only one curb cut shall be permitted from a street, provided: i. The required driveway setback shall be a minimum of five feet (5') for from interior lot lines and cixty fcct (60') the greater of the applicable front yard setback or the required sight triangle from the street side yard property line on corner lots. In the event that a lot of record does not have sufficient width to meet the applicable driveway standards. the width and placement of the required driveway shall be subject to the approval of the City Engineer. ii. The proposed curb cut is in compliance with section 8.1:G 1; iii. All district setback regulations for surface parking and impervious surface limitations are met. (Ord. B -129 6- 3 -03). Section 2: Ordinance shall be effective the day following its publication. Adopted this day of 2005. Case 05 -37 -TA Driveway Setbacks from Corner Lots Text Amendment Mr. Lindahl reviewed the staff report The text amendment was tmnated by staff after determuung that the current driveway setback standards could not be implemented on certain lots within the City. Chairperson Messner asked the Comtmssion if they had any questions for Mr. Lindahl. Chairperson Messner wanted to ensure that vehicles are not backing out and turning into a street at a busy intersection Mr. Lindahl stated that staff feels this compromise would still allow sufficient area for movement at the intersections and preserve the site triangle, vehicle stacking. Chairperson Messner again stated his concerns with driveways being close to intersections. Mr. Lindahl stated thus text amendment will allow driveways to move closer to intersections but staff does feel that even with the reduction in the setback we are still preserving a safe maneuvering area and the site triangle Commissioner Messner opened the Public Hearing. There was no public comment. MOTION by Messner to close the Public Hearing. Second by Powell. Ayes: All. Nayes: None. Motion approved. MOTION by Zurn to recommend the City Council adopt an ordinance amending section 7.2,C.6 d (Supplemental Yard Regulations) relating to dnveway setbacks. Second by Schultz. Ayes. Schultz, Zum and Powell. Nayes• Messner. Motion carved 3 -1.
