RECOMMENDED ACTION: Motion to approve a new rental agreement for City on a Hill
Church to rent the Assembly Hall on Sunday mornings in 2017 for $175 per day.
ISSUE
City staff recently received a request from City on a Hill Church to pay a reduced rate for the use of the
Assembly Hall at the Steeple Center on Sunday mornings. The church has requested that the City reduce
the rental rate for the Assembly Hall at the Steeple Center from $225 per day to $175 per day. The request
is for their use of the Assembly Hall during the 2017 calendar year. The written request from City on a Hill
church is attached. The church would still pay full price to use room 200/201, which is $125 per Sunday
morning.
In the past staff has shared with the Council that City on a Hill Church has been a good customer. They
have always paid their rental fees on time, are flexible during construction projects at the Steeple Center
and also work well with other user groups who at times impact the Church’s ability to fully use the
Assembly Hall space.
SUMMARY
Staff is requesting City Council consider approving a new rental agreement for City on a Hill Church to
rent the Assembly Hall on Sunday mornings during 2017 for $175 per day.

RENTAL AGREEMENT
This agreement, made this _____ day of December, 2016, by and between the City of Rosemount, Parks and
Recreation Department hereinafter called the CITY, and Bruce Bentley, Lead Pastor of City on a Hill Church
hereinafter called the RENTER.
WITNESSETH: The CITY and the RENTER, in consideration of rents, covenants, and agreements herein
reserved and contained, do hereby agree with each other as follows:
1. The CITY grants and the RENTER accepts rental of the following described portions of the Rosemount
Steeple Center, 14375 South Robert Trail in the City of Rosemount, Dakota County, Minnesota, to wit
the Rosemount Steeple Center, for a term from January 1, 2017 to December 31, 2017, and restricted to
the attached permit schedule, for specific use of conducting Church Services for City on a Hill Church.
2. As rent for the said portions of the Rosemount Steeple Center, the RENTER agrees to pay to the CITY,
the sum of $15,900, payable in monthly payments to be due and payable by the RENTER in advance of
the first of each calendar month. The CITY will invoice the RENTER each month.
3. A damage deposit of $200.00 will be assessed (the $200.00 refundable damage deposit will be carried
over from 2011) to the RENTER and will be itemized on the facility use permit. The damage deposit
will be refunded by check from the City of Rosemount upon termination or expiration of the lease,
pending there are no damages to the Rosemount Steeple Center or any infractions of the Rental
Agreement or Facility Use Permit.
4. The RENTER shall agree to pay the CITY for damages to the premises caused by activities and or
persons attending, staffed by, or otherwise affiliated with City on a Hill Church.
5. The RENTER agrees to remove all belongings by the end of each daily rental. The RENTER is
responsible to adhere to the general facility rules and to inform members of the rules as outlined in the
Use Procedures, Policies and Rental Agreement. There is no storage available at the Steeple Center.
6. The RENTER shall move tables and chairs to desired set-up; the CITY will return tables and chairs to
original position by the end of each daily rental.
7. The RENTER agrees that no signs or other advertising materials shall be erected or affixed to any
portion of the interior or exterior of the premises without the express prior written consent of the CITY.
The RENTER shall request authorization of signage in writing to the CITY.
8. The RENTER will not make any alterations, repairs, additions, or improvements in or to the premises
or add, disturb or in any way change any locks, plumbing, or wiring without the express prior written
consent of the CITY.
9. The RENTER agrees not to assign this lease, or any portion thereof, to or for any other purpose,
organization, or party other than City on a Hill Church, without first obtaining written consent of the
CITY.
10. The RENTER shall agree to maintain an address other than that of the CITY. All mail for the

RENTER shall be directed to the address of the RENTER at all times. The RENTER shall agree to
maintain a phone number other than any and all phone numbers assigned to the Steeple Center or the
CITY. The RENTER shall agree to direct all RENTER calls to any phone number other than any and
all phone numbers assigned to the facility of the CITY.
11. The RENTER agrees to and shall abide by, conform to, and comply with all laws of the United States
and the State of Minnesota and all of the ordinances of the City of Rosemount, and the rules and
regulations of the CITY, together with all rules of the Police and Fire Department from the City of
Rosemount.
12. The CITY, the City of Rosemount, its officers and staff, shall not be responsible for any claim
whatsoever regardless of kind, occurring during the tenancy of the RENTER and the RENTER shall
indemnify the CITY, the City of Rosemount, its officers and staff, and save them harmless from any and
all claims, damages, expenses and liabilities whatsoever arising out of and or during the RENTER'S use
of the leased premises. Furthermore, the RENTER shall obtain all permits or licenses required by any
provision of law, municipal charter or ordinance for the conduct of activity on the leased premises and
the CITY shall not be responsible for the RENTER'S failure to obtain such permits and licenses or to
comply with any other requirements imposed upon the RENTER for conduct of activity.
13. The RENTER agrees to full responsibility for the character and acts of conduct of all persons admitted
to City on a Hill Church on the premises, and to have on hand sufficient policing force to maintain order
and protect persons and property.
14. This lease may be terminated by either party for any reason upon at least four (4) months written notice
to the other. This lease shall terminate at midnight on December 31, 2017 with no extension or holding
over unless the parties have agreed upon terms and a new written lease has been executed.
15. The RENTER agrees to maintain adequate liability insurance in an amount no less than $1,000,000.00,
naming the City of Rosemount additionally insured. The RENTER agrees to provide property
insurance for personal property that it uses or on the premises. The RENTER shall provide the CITY
with proof of insurance required by the paragraph.
16. The RENTER has been made aware of the construction taking place on the property next to the Steeple
Center in 2014. The CITY has agreed to make reasonable accommodations if necessary during the
construction project phase.

Reservation includes use of Assembly Hall and Room 200/201 according to the dates and times listed on this permit.
The "end time" listed on permit means all guests and all items brought into building by renter will exit the Steeple Center at this time.
Any change in the "end time" will constitute a violation of the Permit and Rental Agreement.
Steeple Center Kitchen rental consists of use of counters, sinks, refrigerator and ice machine. No use of ovens, dishwasher or
garbage disposal. Food must be prepared by a licensed caterer. No food or items brought into the kitchen will be left after "end
time" on permit. All tables, and kitchen counters will be wiped down by client and floor swept before exit time listed on permit.
Steeple Center Staff will setup and take down tables and chairs according to setup approved prior to day of service.
