ATTACHMENTS: Payment Voucher APPROVED BY: ddj RECOMMENDED ACTION: Motion to Approve Payment 5 and Final to McNamara Contracting for the Danbury Way Improvement Project, City Project 453 and Accepting it for Perpetual Maintenance BACKGROUND: This item is on the agenda to request Payment 5 and Final to McNamara Contracting for the Danbury Way Improvement Project, City Project 453. The final construction amount of $1,305,103.30 is 5.7% greater than the original contract amount of $1,234,503.50. The increase in contract amount is due to extra work for the contractor to locate and identify unmarked and unknown private utilities throughout the project area, increased driveway removals and new concrete driveways to accommodate existing driveway grades, increased aggregate base class 5 quantity due to reclaim that did not meet specifications in limited areas due to the existing roadway conditions, and adding a fourth rain garden to the project. The project construction amount came in 21.7% below the feasibility estimate of $1,666,700. SUMMARY: Staff recommends that Council approve Payment 5 and Final for the Danbury Way Improvement project and accept the project for perpetual maintenance subject to the following conditions. 1. Satisfactorily showing that the contractor has complied with the provisions of Minnesota Statutes 290.92 requiring withholding state income tax. 2. Evidence in the form of an affidavit that all claims against the contractor by reasons of the contract have been fully paid or satisfactorily secured. 3. Consent of Surety to Final Payment certification from the contractor’s surety. 4. Two-year Maintenance Bond.
