RECOMMENDED ACTION: Motion to approve a resolution renewing the Interim Use
Permit (IUP) for J & C Nordberg, Inc. to allow the continued operation of the Adventure
Zone, subject to conditions.

The applicant,J & C Nordberg, Inc. (DBA: The Adventure Zone), requests renewal of their existing
interim use pen-nit (IUP) to allow the continued operation of the Adventure Zone paintball field.
The Adventure Zone is located on the western half of the Endres Processing site located at 13420
Courthouse Boulevard (Hwy. 55). The Adventure Zone has operated this paintball game field in
this same location under their existing IUP since 1994. The permit was last renewed in May of 2004
and allows this Commercial Outdoor Recreation use, subject to conditions,through 2007. The
subject property is zoned and guided GI—General Industrial. Paintball fields are allowed through
an interim use permit in the General Industrial District.
The City is requiring renewal of this IUP at this time because the property owner (Endres
Properties,LLC) wishes to subdivide their existing single parcel into three separate parcels for
potential development. The proposed subdivision would divide the Adventure Zone business over
two separate properties. The intent of this renewal is to modify the IUP to ensure it reflects the new
legal descriptions proposed by the plat. Staff and the Planning Commission are recommending
approval of the proposed plat under a separate item on this agenda. Should the City approve the
renewal request, The Adventure Zone would continue to operate on Lots 1 and 3,Block 1 of
Endres Properties 2nd Addition through 2009. It should be noted that if the owner of Lot 1, Block 1
seeks development approvals for this property, the City may revoke the IUP requiring the
Adventure Zone to cease operation.
PLANNING COMMISSION ACTION
The Planning Commission held a public hearing to review this item on May 23, 2006. Excerpt
minutes from that meeting are attached for your reference. After hearing from staff and receiving no
public comment during the public hearing, the Commission unanimously recommended the City
Council approve this IUP request.
Interim Use Permit Review
Interim Use Permits are intended to permit the temporary use of a property for a specific use until a
particular date,until the occurrence of a particular event or until zoning regulations no longer permit
the proposed use. The standards and findings necessary for reviewing an interim use permit
application are outlined in Section 11-10-08. The City must approve or deny each IUP request based
on findings related to these criteria. Staff's review and findings for these criteria are outlined below.
Should the City approve an IUP request,it may attach conditions to mitigate anticipated adverse
impacts associated with the use, ensure compliance with the standards of approval,protect the value
of other property, or achieve the goals and objectives of the comprehensive plan.
Standards
1. The interim use must be allowed in the zoning district where the property is located.
Finding: The subject property is zoned GI—General Industrial and Commercial Outdoor
Recreation is listed as an Interim use in this district.
2. The interim use must meet or exceed the performance standards set forth in this title and other
applicable city ordinances.
Finding: The Adventure Zone site consists of a gravel parking area and several playfields which
contain various accessory structures. Staff finds these structures and their location consistent
with the performance standards for the GI— General Industrial District.
3. The interim use must comply with the specific standards for the use identified in this title, and
must comply with all conditions of approval which shall be included in an IUP agreement.
Finding: Attach is a copy of the IUP for the Adventure Zone. Staff finds the subject property
in conformance with these conditions. Violation of any condition or otherwise unlawful activity
may result in immediate revocation of the IUP.
Findings
1. The extent,location, and intensity of the use will be in substantial compliance with the
comprehensive plan.
Finding: The Comprehensive Plan identifies the subject property as GI—General Industrial.
Staff finds the continued use of this site for commercial outdoor recreation is consistent with the
Comprehensive Plan.
2. The use will provide adequate ingress and egress to minimize traffic congestion in the public
streets.

Finding: The site has access through a gravel driveway and parking area to the Endres private
driveway which in turn has access to TH 55. Several conditions of the IUP address access and
parking issues. Staff finds the subject property in compliance with these standards.
3. The use will not be detrimental to the existing character of the development in the immediate
neighborhood or endanger the public health, safety, and general welfare.
Finding: The Adventure Zone and Endres Processing have coexisted next to each other since
1994 without a major incident. Nonetheless, staff recommends periodic inspection of these uses
to ensure their continued complimentary operation and preservation of the public health, safety
and general welfare.
4. The use will not impede the normal and orderly development and improvement of the
surrounding property for uses permitted in the district.
Finding: With the subdivision of this site into three separate parcels, the property containing the
Adventure Zone could redevelop into any use allowed in the General Industrial district. Should
the property owner wish to redevelop the site the City may revoke the Adventure Zone IUP.
5. The use shall,in all other respects, conform to the applicable regulations of the district in which
it is located.
Finding: The subject use is consistent with the GI— General Industrial land use and zoning
classifications. Given its design and operation,many of the typical zoning performance
standards (loading,building materials, trash enclosure,landscaping, lighting, and the like) do not
apply. Nevertheless, several conditions of the IUP require continued compliance with all
applicable standards. Should the applicant wish to alter any of these items they would first need
to amend this interim use permit.
CONCLUSION & RECOMMENDATION
Staff recommends renewal of an Interim Use Permit allowing the continued operation of the
Adventure Zone paintball field subject to final plat approval of Endres Properties 2"d Addition and
the conditions outlined in the 2006—2009 Interim Use permit. The Adventure Zone's existing IUP
was issued in 1994 and allows this Commercial Outdoor Recreation use to operate, subject to
conditions, through 2009. Renewal of this IUP is necessary at this time because the property owner
(Endres Properties,LLC) wishes to subdivide their existing single parcel into three separate parcels
for potential development. The Endres Properties 2"d Addition plat would divide the Adventure
Zone business over two separate properties. The intent of this renewal is to modify the IUP to
ensure it reflects the new legal descriptions proposed by the plat. The Planning Commission has
held public hearings for both the proposed plat and the revised IUP and recommends approval by
the City Council. Should the City approve the renewal request,The Adventure Zone would

A RESOLUTION RENEWING THE INTERIM USE PERMIT FOR
J & C NORDBERG, INC.
TO ALLOW THE CONTINUED OPERATION OF
THE ADVENTURE ZONE
WHEREAS, the Community Development Department of the City of Rosemount received an
application from J &C Nordberg dba the Adventure Zone requesting approval of an Interim Use
Permit renewal for continued operation of the Adventure Zone paintball fields,located at 13420
Courthouse Blvd.,legally described as:
Lots 1 and 3,Block 1, Endres Properties 2nd Addition.
WHEREAS, on May 23, 2006, the Planning Commission of the City of Rosemount held a public
hearing to review the Interim Use Permit application from J & C Nordberg dba Adventure Zone for
continued operation of an outdoor recreational use (paint ball field); and
WHEREAS, the property owner, Endres Properties,LLC,wishes to subdivide their existing
property into three separate lots,legally described as Lots 1,2, and 3,Block 1,Endres Properties 2nd
Addition; and
WHEREAS, the Adventure Zone will operate on all of Lot 1 and part of Lot 3, Endres Properties
2nd Addition;and
WHEREAS, the Planning Commission of the City of Rosemount found the existing operation on
the newly described properties primarily consistent with the previous Interim Use Permit as it was
approved; and
WHEREAS, the Planning Commission adopted a motion to recommend that the City Council
approve the renewal of the Interim Use Permit for J & C Nordberg dba Adventure Zone subject to
the conditions in the 2006-2009 Interim Use Permit (Exhibit A); and
WHEREAS, on August 15, 2006, the City Council of the City of Rosemount reviewed the Planning
Commission's recommendation and the 2006-2009 Interim Use Permit for J & C Nordberg dba
Adventure Zone.
NOW,THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the 2006-2009 Interim Use Permit for continued operation of the Adventure Zone
paintball fields, subject to approval of the Final Plat for Endres Properties 2nd Addition and the
conditions listed in the 2006-2009 Interim Use Permit (Exhibit A).

2006-09 Interim Use Permit Conditions for
The Adventure Zone
Commercial Outdoor Recreation Use located in the General Industrial District
This Interim Use Permit (IUP) is valid only for Lots 1 and 3,Block 1, Endres Properties 2nd
Addition, Dakota County,Minnesota.
1. This permit shall be in effect for the calendar years of 2006, 2007, 2008, and 2009, from
January 1, 2006 to December 31, 2009.
2. The Adventure Zone shall be limited to the area illustrated on the Adventure Zone Site
Map attached as Exhibit A.
3. The City may revoke this permit should the owner of Lot 1, Block 1, Endres Properties
2"d Addition receive development approval for this property.
4. This permit shall be reviewed prior to renewal in 2009 for conformance with these
conditions. Thereafter the City Council will determine the appropriate time interval for
the subsequent renewal procedure.
5. Violation of any specified IUP condition or otherwise unlawful activity may result in
immediate revocation of the IUP.
6. All site improvements shall be reviewed by the City Engineer for approval prior to
completion in accordance with City standards including grading permits.
7. The hours of operation shall be limited to 8:00 a.m. to 10:00 p.m.
8. No parking is allowed in the Minnesota Department of Transportation (MnDOT) State
Trunk Highway (STH) 55 right-of-way.
9. All permits required by other applicable agencies must be obtained and copies submitted
to the City. This requirement includes any MnDOT permits affecting the STH 55 right-
of-way.
10. All development and dimensional standards of the zoning ordinance apply to future
improvements of the Adventure Zone with the exception of paving requirements.
11. Parking areas must consist of a minimum of six (6) inches of compacted, crushed
limestone or other such material acceptable to the City Engineer, and shall be maintained
accordingly.
12. The driveway shall be combined with the approved Endrus Processing driveway, and
shall not impact or encroach upon the STH 55 ditch. The site and STH 55 ditch shall be
maintained free of litter as a requirement of the IUP.
13. All structures must conform to the Uniform Building Code and City of Rosemount
Zoning Ordinance requirements for materials and aesthetics.
14. Conformance with Dakota County Health standards for portable sanitary facilities.
15. Conformance with the City of Rosemount Sign Ordinance.

06-36-IUP Adventure Zone Interim Use Permit. Planner Lindahl summarized the staff
report. J & C Nordberg, Inc. (DBA: The Adventure Zone) requested renewal of its existing
interim use permit (IUP) to allow the continued operation of the Adventure Zone paintball
field. The renewal also modifies the properties the business will be operated on. Currently,
Endres is located on one parcel that has received preliminary plat approval. The Adventure
Zone can continue to operate in its current condition which is over two preliminarily platted
lots. The subject property is zoned and guided GI—General Industrial. Paintball fields are
classified as commercial outdoor recreational uses which are allowed through an interim use
permit in the General Industrial District.
