ATTACHMENTS: Payment Voucher APPROVED BY: ddj RECOMMENDED ACTION: Motion to Approve Payment 5 and Final to Ryan Contracting for the Horseshoe Lake Stormwater Lift Station, City Project 466 and Accepting it for Perpetual Maintenance BACKGROUND: This item is on the agenda to request Payment 5 and Final to Ryan Contracting for the Horseshoe Lake Stormwater Lift Station, City Project 466. The final construction amount of $667,284.25 is 3.6% greater than the original contract amount of $644,000.00. The increase in contract amount is due to Change Orders 1 – 3 previously approved by Council, and Change Order 4, which includes extending the 10’ bituminous trail approximately 200’ to meet Aulden Ave to allow access for maintenance vehicles. At the time of bidding, it was assumed the regional trail would be constructed to have provided this connection, but construction of the regional trail has not occurred, so this connection was added to the project. The project is funded by the Storm Core and Stormwater Utility Funds. SUMMARY: Staff recommends that Council approve Payment 5 and Final for the Horseshoe Lake Stormwater Lift Station and accept the project for perpetual maintenance subject to the following conditions. 1. Satisfactorily showing that the contractor has complied with the provisions of Minnesota Statutes 290.92 requiring withholding state income tax. 2. Evidence in the form of an affidavit that all claims against the contractor by reasons of the contract have been fully paid or satisfactorily secured. 3. Consent of Surety to Final Payment certification from the contractor’s surety. 4. Two-year Maintenance Bond.
