ACTION: City Council Meeting: June 7, 2005 CITY OF ROSEMOUNT EXECUTIVE SUMMARY FOR ACTION ISSUE Council is asked to approve a resolution in support of allowing MLBA Children's Fund to maintain charitable gambling pull-tabs at McDivot's Sports Pub and Eatery, 14550 South Robert Trail. BACKGROUND Charitable gambling is controlled by Minnesota Alcohol and Gambling Enforcement. Rosemount City Council's approval is necessary for MLBA Children's Fund to proceed with their application to the State. The MLBA Children's Fund believes they will benefit the community and are aware that 80% of gambling proceeds are to be spent within the boundaries of Rosemount or its contiguous cities. McDivot's owner, Bill Schneider, said he will have more input as to where the proceeds go with MLBA's charitable gambhng organization. Mr. Schneider gave a proper sixty-day notice to the Rosemount Jaycees. SUMMARY Staff has reviewed the application and conducted an investigation on Gambling Manager Colon Minehart There are no apparent reasons to deny the Gambhng on Premises license. A RESOLUTION APPROVING A CHARITABLE GAMBLING PREMISES PERMIT FOR McDIVOT'S SPORTS PUB AND EATERY, 14550 SOUTH ROBERT TRAIL WHEREAS, the Rosemount Junior Chamber known as the Rosemount Jaycees, have been noticed that they will no longer be operating the chantable gambling at McDivot's Sports Pub and Eatery after July 1, 2005; and WHEREAS, the MLBA Children's Fund Gambling Manager Colin Minehart has approached the City of Rosemount to qualify for chantable gambling at McDivot's Sports Pub and Eatery after July 1, 2005 for a two year permit WHEREAS, the Minnesota Licensed Beverage Association Children's Fund, Inc. has been established since 1985 and has supplied this office with proper proof of incorporation; and WHEREAS, the Gambling Manager Colin Minehart has several years experience with charitable gambling regulations. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Rosemount, Dakota County, Minnesota, hereby approves the MLBA Children's Fund for a Charitable Gambling Premises Permit to conduct chantable gambling in Rosemount at the McDivot's Sports Pub and Eatery at 14550 South Robert Trail for the period of July 1, 2005 to June 30, 2007. Also the Children's Fund has submitted (on 5/12/05) a $100 licensing fee to the City of Rosemount. Our intention is to begin operations on July 1, 2005 at the McDivit's location.
