Rosemount Plaza Condominiums PUD Minor Amendment Case 05-31-AMDAGENDA ITEM: Case 05- 31 -AMD Rosemount Plaza Condominiums PUD Minor Amendment AGENDA SECTION: Consent PREPARED BY: Rick Pearson, City Planner AGEf.6 P ATTACHMENTS: Draft Resolution, Location map, Site Plan APPROVED BY /jam/ RECOMMENDED ACTION: Motion to adopt a resolution approving the minor UD Amendment for the Rosemount Plaza Condominiums 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: July 5, 2005 EXECUTIVE SUMMARY ISSUE Mr. Wayne Lucking, President of the Rosemount Plaza Condominium Homeowner's Association has requested approval of site work between the west side of the condominium building at 14575 Burma Avenue and the parking lot north of 146 Street West. Ordmardy, this minor amount of work could be approved admuustrattvely However, pubhc funds were contributed to the landscaping for the Rosemount Plaza project 20 years ago, and therefore, Council action is appropriate Further the project approval was part of a PUD and therefore a minor amendment must be processed BACKGROUND Rosemount Plaza was a redevelopment project for the entire block east of South Robert Trail and south of 145 Street West It included the 3 commercial buildings, senior high -rise and the 21 -unit condominium building The City Housing and Redevelopment Agency contributed $40,000 for site improvements for the entire PUD, including landscaping, benches and sidewalks m 1985. Staff has attempted to find more detailed documentation of the distribution of funds, but no additional records have been found. The condominium site comprises shghtly less than 1/4 of the block m the southeast corner. The homeowner's association intends to remove a fountain (m need of repair) and about 3,280 sq. ft. of concrete paving within the condominium site. Pedestrian linkages will be maintained with sidewalk improvements or replacement connecting budding entrances to the northwest corner of the parking lot and the sidewalk at 146` Street West. Several steps will be removed, thus responding to Americans with Disabilities Act (ADA) standards for access. Sod will replace most of the paved area around the fountain and a concrete walkway between the budding and the parking lot. Mr. Lucking indicates that the homeowner's association is reluctant to repair and continue to mamtain the fountain. Staff feels that the concrete walk way is redundant, as it connects to the sidewalk at mid -block along 146 Street. The entire block is ringed with sidewalks, and the parking lot connects the plaza area with the 146 Street sidewalk. The documentation received from the association indicates that 17 votes concerning the project were received with 15 who voted yes, 2 voted no, and 4 did not respond. Therefore, 71% voted m the affirmative. The original Architect did contact staff to explain he was against the proposal, and wanted the plaza site improvements to remain status quo. RECOMMENDATION Staff supports adoption of the resolution approving the minor PUD amendment. The pavement intended for removal can become "green space and appears to be redundant to the circulatton pattern. The approval allows removal of the fountain and conversion to green space consistent with the attached drawing. 2 ATTEST: Motion by: Voted in favor: Voted against: Member absent: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2005 A RESOLUTION APPROVING A MINOR AMENDMENT TO THE ROSEMOUNT PLAZA CONDOMINIUMS PLANNED UNIT DEVELOPMENT MINOR AMENDMENT WHEREAS, the Community Development Department of the City of Rosemount received an application from Rosemount Plaza Condominiums Homeowner's Association requesting a Planned Unit Development "PUD Minor Amendment to obtain approval for site work between the west side of the building at 14575 Burma Avenue and the parking lot north of 146 Street West. WHEREAS, this request does not affect the number of buildings, housing mix, or location. Nor does it impact streets or parking or create the need for new setback variances. As such, it is a minor amendment, not requiring Planning Commission review or a public hearing by ordinance; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the minor amendment to the Rosemount Plaza Condominium PUD to allow for the site work requested per the attached Exhibit A.
