Add -on to New Business Phal Partnership Rosemount Business Park Lot Split April 17, 2003, City Council approved a lot split to acquire 10 acres of land from the Pahl Partnership south of Boulder Avenue in the Business Park The Dakota County Auditor's Office would not accept the approved resolution due to an error in the land description and noticed the City Clerk. Resolution 2003 -39 should be repealed due to the error. City Attorney LeFevere prepared the new resolution to resolve the issue. Staff recommends approval of two motions, one to repeal Resolution 2003 -39 and one to adopt A RESOLUTION APPROVING A LOT SPLIT FOR THE CITY OF ROSEMOUNT. 2. Pubhc Comment new information Staff received a copy of a flyer asking interested ones to attend tonight's City Council meeting in support of changing County Road 38 east of the railroad tracks. There was the unfortunate death there on July 21 of sixteen year -old Kyle Parker The City Clerk's Office received a petition on July 27, 2005 with 406 signatures that petitioned: "that 135th Street is dangerous and should have the bend removed, straightening the road." APPROVED BY: RECOMMENDED ACTION: Motion to repeal Resolution 2003 -39; and, Motion to adopt a resolution approving a lot split for the City of Rosemount. 4 ROSEMOLINT CITY COUNCIL City Council Meeting: August 1, 2005 EXECUTIVE SUMMARY ISSUE In April of 2003, the City Council approved a lot spht to acquire 10 acres of land from the Pahl Partnership south of Boulder Avenue in the Business Park The land was offered in heu of payment of assessments. Subsequently, the City attempted to record the lot split with Dakota County Dakota County would not accept the City resolution because of a formatting error. City Attorney Charlie LeFevere has prepared a revised resolution for adoption that resolves the issue. BACKGROUND The land acquired from the Pahl Partnership will provide a well site and a site for a possible future water treatment facthty. The site is contiguous with the crescent shaped Outlot B, a remnant of the Business Park on the south side of Boulder Avenue. Outlot B is expected to be subdivided and recombined at the discretion of the Port Authority with future lots subdivided from the Pahl property when development occurs, facilitating lot frontage on Boulder Avenue. The unusual shape of the 10 acre lot is a function of the Irrigation pivot on the Pahl property. Ten acres is more than necessary for the intended purpose, and the excess land may be conveyed to facilitate development of surrounding properties, also at the discretion of the Port Authority. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2005- A RESOLUTION APPROVING A LOT SPLIT FOR THE CITY OF ROSEMOUNT WHEREAS, the Planning Department of the City of Rosemount received an apphcanon from the City of Rosemount for approval of a division of property, said property legally described as. The South Half (S 1/2) of the Northeast Quarter (NE 1/4) AND the North Half (N 1/2) of the Southeast Quarter (SE 1/4), all in Section Thirty -two (32), Township One Hundred Fifteen (115), Range Nineteen (19), Dakota County, Minnesota. The South Thirteen (13) feet of the East 525 feet of the North Half (N 1/2) of the Northeast Quarter (NE 1 /4) of Secuon Thirty -two (32), Township One Hundred Fifteen (115), Range Nineteen (19), Dakota County, Minnesota. EXCEPTING THEREFROM THE FOLLOWING THREE PARCELS 1) The South 466.69 feet of the East 466.69 feet of the North Half (N 1/2) of the Southeast Quarter (SE 1 /4) of said Secnon 32, 2) The North 46669 feet of the East 466.69 feet of the North Half (N 1/2) of the Southeast Quarter (SE 1/4) of said Section 32.
