Minnesota. BACKGROUND ALDI Inc Minnesota has submitted an application for an off -sale 3 2% liquor license for a grocery store located in the Steiner Development, Rosemount Crossing, at the cross streets of Highway 3 and County Road 42. The 3 2% malt liquor license will be valid until June 30, 2006. ALDI's grand opening is scheduled for August 4, 2005 Off -sale 3.2% Malt Liquor Licenses are not limited by City ordinance or State law. James Sudduth is the local manager. Mr. Sudduth lives in Eagan and was Assistant Manager at an ALDI's Grocery in Richfield, Minnesota. Police Lt. Dwayne Kuhns conducted a full investigation on the manager and ALDI's President, CEO, and Secretary /Treasurer No crummal record was found. Lt. Kuhns also contacted metro area cities with an ALDI grocery store providing 3.2% malt liquor. The cities of Savage, Minnetonka, Brooklyn Park, Coon Rapids and Inver Grove Heights reported no liquor license violations had occurred Lt. Kuhns memo is attached. SUMMARY Staff finds no reason to withhold the off -sale 3.2% malt liquor license. The recommendation is to approve the off -sale 3.2% malt liquor license to ALDI Inc. Minnesota at ALDI Grocery Store No. 61, 14995 South Robert Trail, and beginning on August 2, 2005 through June 30, 2006. Dwayne Kuhns Date: July 13, 2005 Subject: Liquor License Background Investigation Aldi's I was requested to conduct a background investigation regarding the issuance of a "3.2 off- sale" liquor license to Aldi's Foods; the following is a summary of that investigation. Aldi Incorporated is a privately held corporation owned by Hofer KG, Sattledt, Austria. Francis Frazier, Charles Youngstrom and Terry Pfortmiller are officers of Aldi Inc. Mr. Frazier is the Chairman/CEO, Mr. Youngstrom is the President and Mr. Pfortmiller is the Secretary/Treasurer all currently reside in Illinois. The store manager is James Sudduth who resides in Eagan. The license applicants did provide a certificate of liability insurance, which was issued by Frenkel Co. Inc. of New York, NY. Criminal background and records checks where conducted on all corporate officers and the store manager. No criminal record was found on any of the officers or the manager. Inquiries were also made with other cities where Aldi's Foods hold liquor licenses, those cities being, Savage, Minnetonka, Brooklyn Park, Coon Rapids and Inver Grove Heights all cities advised that they have had no liquor license violations.
