Adopt an Ordinance rezoning the Carrousel Plaza Townhomes to R -2 PUD. 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: March 21, 2006 EXECUTIVE SUMMARY INTRODUCTION The City has initiated a reguiding and rezoning process to bring these residential projects out of the Business Park zoning and land use. As part of the Business Park zomng text amendment, staff is recommending that residential uses not be permitted in the Business Park district. The change would make the properties non conforming unless they are rezoned and reguided to an appropriate land use and zoning designation. It has been determined that the Claret Springs East Townhomes and the Carrousel Plaza Townhomes should be designated Urban Residential and rezoned to R -2 PUD. The Wachter Lake Condominiums should be designated Urban Residential and rezoned to R -3 PUD. The reason for the PUD is to recognize the existing approval and related conditions. By rezoning to PUD the currently approved plans will become the Master Development Plan for the project and would be subject to appropnate conditions already approved. Use of the PUD is also consistent with the ptevious approval process which used the PUD overlay with the Business Park zoning district. BACKGROUND The Claret Spring project was approved on August 18, 1998. There were 121 units within 26.88 acres for an overall density of 4.5 units /acre. The Wachter Lake Condominiums project was approved on April 16, 2002. There are 48 units located on 5 acres with an overall density of 9 6 units /acre. The Carrousel Plaza project was approved on March 7, 2001. There are 38 units located on 8.33 acres for an overall density of 4.56 units /acre. DISCUSSION The recommended change comes about due to proposed changes in the Business Park zoning district. The draft ordinance, soon to be scheduled for Council action, will remove the opportunity to locate residential uses in the BP -4 district, with PUD. Even though there have been several discussion points relating to the Business Park Distract, such as outside storage, staff expects the ordinance will ultimately be approved without permitted residential uses. Rather than making the property non conforming, staff is recommending a change to the zoning and land use designation that will allow the property to continue m its current fashion These modifications do not change the use on the site or enable changes to be made in the built structure of the property From the resident's standpoint, the change will not alter their use of the property and will allow the property to have a "conforming" status, should the association choose to modify the PUD at some future date or if individual homeowners refinance or sell their property. 2 and ATTEST: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2006- A RESOLUTION APPROVING THE COMPREHENSIVE GUIDE PLAN AMENDMENT TO THE CLARET SPRINGS EAST ADDITION WHEREAS, the Community Development Department of the City of Rosemount requested a Comprehensive Guide Plan Amendment to =guide the properties located m the Claret Spnngs East Addition to bring the residential project out of the Business Park zoning and land use. WHEREAS, on February 28, 2006, the Planning Commission of the City of Rosemount held a pubhc hearing to receive public comment on the Comprehensive Guide Plan Amendment changing the land use m the Claret Springs East Addition from BP, Business Park to UR, Urban Residential; WHEREAS, the Planning Commission adopted a motion to recommend that the City Council approve a 2020 Comprehensive Plan Amendment for the Claret Springs properties as depicted on the attached map incorporated into and attached hereto as Exhibu A, Claret Springs East Addition from BP, Business Park to UR, Urban Residential; and WHEREAS, on March 21, 2006, the City Council of the City of Rosemount reviewed the Planning Commission's recommendation and the Comprehensive Guide Plan Amendment reguiding the properties m the Claret Springs East Addition. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Comprehensive Guide Plan Amendment reguidmg the property in the Claret Springs East Addition as outlined above and illustrated on Exhibit A, subject to Metropolitan Council approval. Ms. Lindquist reviewed the staff report and spoke to the next three items. The items are part of the zoning text amendment to the Business Park The three projects are residential uses withm the Business Park as part of the last Comprehensive Plan. It is likely, regardless of some of the other issues that are the outcome of the Business Park district, that most people will support the removal of residential uses m the Business Park. The neighborhoods have been notified of the change. Staff recommends approval of Items 5.b., 5.c., and 5.d. Chairperson Messner opened the Public Hearing.
