EXECUTIVE SUMMARY SUMMARY Applicant Property Owner(s): The City of Rosemount Location: North of Boulder Avenue and Southwest of Lot 1, Block 1, Rosemount Business Park Second Addmon (Webb Companies 15197 Boulder Avenue) Area in Acres: 1.08 Acres Outlot A) Comp. Guide Plan Desig Business Park Current Zoning: BP- Business Park 2 BACKGROUND The City of Rosemount initiated this easement vacation to remove an existing 10 foot drainage and utility easement over a portion of Outlot A, Rosemount Business Park Second Addition Tlus easement must be removed prior to Outlot A being replotted as part of the new JJT Business Park First Addition plat With the inclusion of Outlot A into the JJT Business Park First Addition Plat, the City finds this drainage and utility easement is no longer necessary. As a result, staff recommends vacation of this easement. A RESOLUTION CAUSING EASEMENT VACATION IN OUTLOT A OF ROSEMOUNT BUSINESS PARK SECOND ADDITION WHEREAS, a public hearing was scheduled and held before the City Council of the City of Rosemount on April 4, 2006 after due pubhcanon as required by law, and all interested persons were given an opportunity to be heard, and WHEREAS, it appears the current drainage and utility easement on the property legally described as Outlot A, Rosemount Business Park Second Addition serving a pubhc purpose is based upon the property in a predevelopment state, and; WHEREAS, Outlot A of Rosemount Business Park Second Addition is proposed to be included in the new JJT Business Park First Addition plat and will no long be an separate parcel; NOW THEREFORE BE IT RESOLVED, that the following drainage and utility easement is hereby vacated, to wit: A 10.00 foot wide public drainage and utility easement over, under, across, and adjoining the boundary lines of Outlot A, ROSEMOUNT BUSINESS PARK SECOND ADDITION, Dakota County, Minnesota, according to the recorded plat thereof. BE IT FURTHER RESOLVED, that the City Attorney shall prepare a nonce of completion of the proceedings and necessary Quit Claim Deeds which shall contain the name of the City, identification of the vacation and a statement of the ume of completion thereof, and shall present the same to the County Auditor and then file a copy with the County Recorder.
