EXECUTIVE SUMMARY
ISSUE
Don Kern of Flint Hills Resources has requested approval of a Comprehensive Plan amendment to
include several parcels of land into the Metropolitan Urban Service Area (MUSA). Three separate parcels
along the eastern and southern edge of the refinery area are included m the request. The impetus of the
request is to provide urban samtary sewer service to these specific sites. Currently, 197,225 gallons of
sanitary waste is removed from the refinery and trucked to the metro wastewater treatment plant m St.
Paul. The trip generation for the sanitary waste removal is estimated at 50 trips per month.
BACKGROUND
Apphcant Property owner: Don Kern of Fhnt Hills Resources, L.P.
Location area: Parcel 1 approximately 16.4 acres including the administration building.
Parcel 2 approximately 10 acres including to former Solberg shop site.
Parcel 3 approximately 39 acres northwest of the Union Pacific Railroad
crossing and U.S. 52 for a future warehouse project.

Include the combined 65.4 acres of general industrial land m the
MUSA for sanitary sewer service.
Flint Hills Resources currently has no urban sewer and water. All of the sanitary waste is pumped and
trucked off -site for disposal. The number of employees on the site fluctuates, but m 2006, the number is
expected to be as high as 830, with up to 205 contract employees and 1,200 construction contractors on
site. Facilities for the construction contractors are temporary and fluctuate depending upon the completion
of contracted work
There is an existing industrial MUSA that includes land on all sides of the U.S 52 and County Road 42
intersection and extends northeast to State Highway 55, and down to the SKB landfill. There is no sewer
currently this far north on the west side of U S 52 Flint Hills is expected to petition for installation of the
sewer to provide sewer service to all properties that is part of this application
PLANNING COMMISSION
At the Planning Commission meeting on March 14, 2006 the Commission discussed the comprehensive
plan amendment. There were no questions by the Commussion however, one member of the pubhc
requested clanfication on the uses for the three parcels that are included m the apphcation. With that
clarification the Commission unanimously recommended approval of the Comprehensive Plan
Amendment.
Parcel 1
This lot consists of 16.4 acres of land directly west of the intersection of U.S. 52 and TH 55. The
admuustration building is in the northeast corner which extends to "A" street and south to 6 Street. All
of these referenced streets are private. Office space in Parcel 1 consists of 119,800 sq. ft. and
approximately 200 employees are located here. Approximately 60,000 gallons of waste per month is
removed from this site at this time That material is trucked up to the Metro waste treatment facility in St.
Paul.
Parcel 2
This area consists of approximately 10 acres of land at the southern end of Clark Road, the frontage road
connecting to U. S. 52. The parcel is south of a small tank farm and west of the "flame towers It
includes the former Solberg Aggregate shops, just outside of refinery activity. The intended use of this
parcel would be a pump -out station. Currently, 137,225 gallons of sanitary waste (excluding the
administration building area) are collected throughout the refinery and trucked to the Metro waste
treatment facility m St. Paul. Eventually, the quantity of sanitary waste material coming from this pump
out station would diminish, with the construction of a project intended for Parcel 3
Parcel 3
Parcel 3 is the largest lot at 40 acres. The site was previously mined by Solberg Aggregate for sand
gravel. The site is at the top of a hill north of the Union Pacific railroad line that crosses U S. 52 on the
west side of U.S. 52. Fhnt Hills Resources intends to construct a warehouse and maintenance facility of
122,200 sq. ft. on this site in 2008 to 2009. The estimated number of employees would be 230 The
construction of the warehouse project would consohdate workers scattered throughout the refinery and
reduce the amount of sanitary material going through the parcel 2 pump -out station.
INDUSTRIAL POLICIES OF THE 2020 ROSEMOUNT COMPREHENSIVE PLAN
In considering an amendment to the comprehensive plan, the Council should consider the industrial land
use pohcies specified in the plan. The amendment is primarily consistent with the first industrial policy
which is to extend urban services to a regional -scale industrial land use. The proposed amendment also
follows the spirit of other policies by allowing expansion in an area where services can be available
CONCLUSION
Staff is comfortable in recommending approval of the Flint Hills Resources comprehensive plan
amendment for sewer service or MUSA expansion. The request is consistent with apphcable policies in
the comprehensive plan. There is also the added benefit of removing the truck traffic generated by the
197,225 gallons of sanitary waste currently taken to the Metro waste water treatment plant in St Paul every
month.
RECOMMENDATION
Approve the Resolution.

A RESOLUTION APPROVING THE FLINT HILLS RESOURCES, L.P.
COMPREHENSIVE PLAN AMENDMENT
WHEREAS, the Community Development Department of the City of Rosemount received an
apphcatron from Flint Hills Resources, L.P. requesting a Comprehensive Plan Amendment
concerning property legally described as:
The Northeast Quarter of the Southeast Quarter excepting part in parcel 420 MnDOT
Right -of -Way Plat 19 -144, Section 24, Township 115, Range 19;
The Southeast Quartet subject to 4.64 acres of Highway, Section 13, Township 115, Range
19; and
The South half of the Northeast quarter excepting the eastern 505.6 feet of the Southern 300
feet excepting part in parcel 420 MnDOT Right -of -Way plat 19 -144, Section 24, Township
115, Range 19.
WHEREAS, on March 14, 2006, the Planning Commission of the City of Rosemount held a public
hearing and reviewed the Comprehensive Plan Amendment to include the combined 65.4 acres of
general industrial land in the MUSA for sanitary sewer service, and
WHEREAS, on March 14, 2006, the Planning Commission recommended that the City Council
approve the Comprehensive Plan Amendment for Flint Hills Resources to include approximately
65.4 acres of general industrial land m the Industrial Metropolitan Urban Service Area for sanitary
sewer service, subject to approval of Met Council; and
WHEREAS, on April 4, 2006, the City Council of the City of Rosemount reviewed the Planning
Commission's recommendations; and.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Comprehensive Plan Amendment for Flint Hills Resources to include approximately
65.4 acres of general industrial land in the Industrial Metropolitan Urban Service Area for sanitary
sewer service, subject to approval by the Metropolitan Council.
ADOPTED this 4th day of April, 2006 by the City Council of the City of Rosemount.

Community Development Director Lindquist reviewed the staff report Fhnt Hills
Resources requested approval of a Comprehensive Plan amendment to include several
parcels of land into the Metropolitan Urban Service Area (MUSA). Three separate parcels
along the eastern and southern edge of the refinery area are included m the request. The
impetus of the request is to provide urban sanitary sewer service to these specific sites.
Currently, 197,225 gallons of sanitary waste is removed from the refinery and trucked to the

Chairperson Messner opened the Public Hearing.
Myron Napper, 3381 145 Street East, Rosemount, questioned the uses and locations of the
two proposed buildings. Ms Lindquist responded by showing Mr. Napper a site map
indicating the location of the proposed buildings Ms. Lindquist added Parcel 2 is an
intended pump -out station and Parcel 3 would be a warehouse and maintenance facility.
MOTION by Schultz to close the Public Hearing. Second by Zurn. Ayes: All.
Nays: None. Motion approved.
Chairperson Messner questioned if the property is brought into the MUSA would it affect
the allocation of services to other areas. Ms. Lindquist stated it should not affect the other
areas.
MOTION by Schwartz to recommend that the City Council approve the
Comprehensive Plan Amendment for Flint Hills Resources to include approximately
65.4 acres of general industrial land in the Industrial Metropolitan urban Service Area
for sanitary sewer service, subject to approval of Met Council Second by Schultz.
Ayes. All. Nays: None. Motion approved.

In response to your letter dated January 6, 2006, and per our phone conversation on 1/31
regarding Flint Hills Resources Comprehensive Plan Amendment Application 05- 61 -CP, please
find enclosed with this letter (20) service maps prepared by TKDA dated Ianuary 16, 2006,
depicting the proposed MUSA area for our property on a scale drawing as requested in your letter
and addresses oI the bordering property owners within a quarter mile of our proposed MUSA
area The service map also includes the building sizes, number of occupants in each building as
well as the legal description for each area outlined on the map.
In addition, a potential future pump -out station is planned to be located in PIN 34- 02400 -010-
13 Currently, sanitary waste is collected from a number of existing buildings located within the
refinery, amounting to approximately 197,225 gallons per month, which is taken off -site for
disposal 60,000 gallons of this 197,225 gallons will be from the admen complex and will exit
directly into the new sewer fine from the administration building to the Rosemount line By
adding this pump -out station, FHR would collect all sanitary waste from remaining locations
within the Rosemount portion of the refinery and take to it to this station for disposal Eventually
several of these in plant icfinery locations will be removed from service when we relocate our
staff to the new 2008/2009 Rosemount Warehouse and Maintenance complex
Some of the othei information you had requested on our 1/31/06 phone call pertained to current
and proposed number of employees at the Pine Bend refinery along with total trips by delivery
type vehicles The 2006 number of FHR employee's will be as high as 830, the year 2010 and
beyond projections will be between 800 and 830 We have 200 -250 professional service
contractors currently on site and in 2010 the numbers are projected to be very close to the same.
There will also he between 500 and 1200 consti uction contractors on site depenchng on the
season. however all of these employees will use portable satellite type facilities As far as
dehvenes we currently see 75 -100 deliveries per day M -F and that number should be close to the
same in 2010 and beyond Another note is that —275 people in the numbers above will be
relocating to the new administration and coon actor management complex in Inver Grove Heights.
Our best estimate at how many full time employees using the Rosemount sewer line will be 800-
850. A good reference check for total volumn of waster water genes ated will be the amount of
potable water we currently consume.
In closing, we anticipate reviewing the system capacity sizing requirements with your
engineei ing department to verify that FHR's current and future needs are met
