BACKGROUND: On April 6, 2004 a Feasibility Report was ordered for County Road 38 from Trunk Highway 3 to Blaine Avenue as City Project #387. On February 15, 2005 a public hearing was held and the project for County Road 38 (Bonaire Path) Trunk Highway 3 to east tract line of Reflections Street and Utility Improvements, City Project #393 was ordered. Expanding upon that project, the project was ordered for 132 Court West Street Utility Improvements on February 7, 2006. On October 18, 2005 the remainder of County Road 38 was ordered as County Road 38, Phase II, City Project #387 These three projects and two project numbers have all been given the same fund accounting number and will be bid as one project, under one contract. Since this one project is pursuant to Minnesota Statutes, Section 429.021, Subd. 2, after consulting with the City Attorney on combining this project, this project will now be known as Old County Road 38/132 Court West Street and Utility Improvements, City Project 387, SUMMARY: Staff recommends City Council approve the attached resolution combining City Project #387 and City Project #393. G \ENGPROJ\ 387 \CombmeProiecr387- 393CC4-18 -0G doc WHEREAS, by Resolution No. 2005 -112, adopted by the City Council on October 18, 2005 the City ordered City Project No. 387, known as County Road 38, Phase II, and WHEREAS, by Resolution No. 2005 -17 and Resolution No. 2006 -13, adopted by the City Council on February 15, 2005 and February 7, 2006 respectively, the City ordered City Improvement Project No. 393, known as County Road 38, Phase I, and 132n Court West and County Road 38 (Bonaire Path); and WHEREAS, the City Council has determined that it is the best interest of the pubhc to combine City Project No. 387 and City Project No 393 to be included in one proceeding and conducted as one improvement, all pursuant to Minnesota Statutes, Section 429 021, Subd. 2. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rosemount, Minnesota, that City Project No. 387 and City Project No 393 are hereby combined into one project, designated as City Project No 387, to be referred to as the Old County Road 38 /132n Court West, Street and Utility Improvements ADOPTED this 18th day of Apnl, 2006.
