BACKGROUND:
In connection with the County Road 38 project, Council has discussed on several occasions a proposal to
establish a special connection charge area m -heu of special assessments for sanitary sewer and water
improvements associated with the County Road 38 and 132n Court West project. Staff was ongmally
intending to present this Item to Council this summer. However, at this time, Evergreen Land Services is
negotiating the acquisition of easements with a property owner on Old County Road 38 and the question
of special assessments for sanitary sewer and water service appears to be a critical nett; related to the
successful negotiation of the necessary easements. Therefore, Staff is presenting this item to Council at
this time for Council direction on a final resolution to this item.
As outlined in previous reports and in the attached letter from the City attorney, the City does have the
authority to establish a special connection charge to be collected at the time a property owner connects to
the City sanitary sewer and water system. The estabhshment of this special connection charge would be
m -heu of levying special assessments for sanitary sewer and water to those properties within the defined
area Attached is a map that outlines the area proposed to be included in a special connection charge
district. As a separate item to be reviewed with Council at a future meeting is a proposed amendment to
the City's code that will require property owners to connect to the City sanitary sewer and water system
within 10 years or if their system fails This City code will ensure that the City will recover costs at a future
time.

Should Council determine that the establishment of a special connection charge district for the defined
area is appropriate; Staff will work with the City attorney to prepare an ordinance to present to Council at
a future meeting for adoption.
