EXECUTIVE SUMMARY
ISSUE:
In order to assure that the processing of the eminent domain for easements at 2813 132n Street West,
associated with the Old County Road 38 project, is acceptable staff is recommending that the Council hold
a public hearing. The Council should open the pubhc hearing, take any testimony from interested parties,
and close the heanng. No further action is required at this time. A resolution will be brought before the
Council 30 days after the pubhc hearing is held, which would be June 19, 2006
BACKGROUND:
City staff has been discussing acquiring necessary easements to fac the Old County Road 38 road
project from the property at 2813 132 Street West with the property owners, the Rohrs, for some time
but have been unable to come to a resolution. Holding of the public hearing is part of the process
anticipated m the new eminent domain legislation currently being discussed by the State.
