APPROVED BY: RECOMMENDED ACTION: Motion to approve a Minor Planned Unit Development Amendment for Rosewood Village Second Addition allowing five (5) new housing types and a revised Grading Plan, subject to conditions. 4 ROSEMOUNT City Council Reg ular Meeting: CITY COUNCIL May 16, 2006 EXECUTIVE SUMMARY SUMMARY Applicant Property Owner(s): Ryan Real Estate Location. South of 145 Street, North of the Railroad Spur and West of Biscayne Avenue Area in Acres: 14.5 Acres Comp. Guide Plan Desig: UR Urban Residential Current Zoning: R -1, Low Density Residential PC The applicant, Ryan Real Estate, requests a Minor Amendment to the Rosewood Village Second Addition Planned Unit Development (PUD) Agreement to allow five (5) new housing types and a revised grading plan. The subject property is located south of 145 Street, north of the railroad spur, and west of Biscayne Avenue. By ordinance, Minor PUD Amendments are administratively approved by staff However, given that this is an amendment to a contract the City Council must approve the change. Rosewood Village Second Addition represents the detached townhome portion of the Rosewood neighborhood. It contains 56 detached townhome site, of which approximately one —half of which are developed at this time Currently, the PUD includes ten different townhome styles to choose from. The apphcant wishes to add five additional styles to diversify the neighborhood and offer more options to their customers These new styles are consistent with the architectural and dimensional standards of the original PUD and offer the potential to include basements. With these new housing styles, the applicant has also provided a revised grading plan. This plan has been reviewed by the Engineering Department and found to be in compliance, subject to the conditions oudmed in the May 9, 2006 memo (attached). RECOMMENDATION Staff recommends approval of a Minor PUD Amendment for Rosewood Village Second Addition to allow five (5) new housing types and a revised grading plan. This recommendation is based on the findings that the new housing types are consistent with the architectural and dimensional standards outlined in the original PUD agreement and that the grading plan is acceptable to the Engineering Department. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2006- A RESOLUTION APPROVING A MINOR PUD AMENDMENT FOR ROSEWOOD VILLAGE SECOND ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an apphcanon from Ryan Real Estate requesting Minor PUD Amendment approval concerning property legally descnbed as: Rosewood Village Second Addition, Dakota County, Minnesota. WHEREAS, the amendment would add five (5) new townhome elevations and a corresponding grading plan, copies of which are on file with the City of Rosemount Community Development Department, and of which photo reduced copies are attached as Exhibits 1 through 6; and WHEREAS, this is a Minor PUD Amendment that may be admuustratively reviewed by staff subject to approval of the amended agreement by the City Council; and WHEREAS, staff reviewed these documents and found them in conformance with the spirit and intent of the zoning ordinance, the Comprehensive Plan, and original PUD Agreement for Rosewood Village Second Addition, subject to conditions, and WHEREAS, on May 16, 2006 the City Council of the City of Rosemount reviewed staff's findings NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Minor PUD Amendment for Rosewood Village Second Addition, subject to: 1. Execution of a PUD amendment agreement. 2. Incorporation of comments from the City Engineer outlined in the Memo dated May 9, 2006 inlcudmg• Approval of a grading permit and submission of a $10,000 security m a form acceptable to the City to be retained until all sites are fully developed and a certified as -built grading plan is submitted to the City. NOW, THEREFORE, the Declarant declares that the Subject Property is, and shall be, held, transferred, sold, conveyed and occupied subject to the covenants, conditions, and restrictions, hereinafter set forth. 1. The use and development of the Subject Property shall conform to the Planned Unit Development Agreement except as modified herein. a. The grading of the Subject Property shall conform to the Final Grading Plan, revised 12/29/05, attached hereto as Exhibit A, and the grading shown on Exhibit 2 of the Planned Unit Development Agreement is amended accordingly. b. The obligations and restrictions of this Amendment run with the land of the Subject Property and shall be enforceable against the Declarant, its successors and assigns, by the City of Rosemount acting through its City Council. This Amendment may be amended from time to time by a written amendment executed by the City and the owner or owners of the lot or lots to be affected by said amendment. Hill, Inc., it is the Engineering Depaitment's understanding that the applicant would prefer to grade individual lots as homes are built. Apphcant shall submit a grading permit and $10,000 Letter of Credit to be retained until all sites are fully developed and a certified as -built grading plan is submitted.
