Approve Amendment to the Dakota County Mutual Aid Fire Services AgreementAGENDA ITEM: Approve Amendment to the Dakota County Mutual Aid Fire Services Agreement AGENDA SECTION: Consent PREPARED BY: Dawn Weitzel, Assistant City Administrator AGENDA NO. 6g ATTACHMENTS: Resolution APPROVED BY: RECOMMENDED ACTION: Motion to adopt the resolution Amendment No.1 to the Dakota County Mutual Aid Fire Services Agreement. 4 ROSEMOUNT EXECUTIVE SUMMARY City Council Meeting: June 6, 2006 CITY COUNCIL ISSUE The Cities of West St. Paul and South St. Paul are currendy in the process of consohdating their fire departments mto the South Metro Fire Department. As such, the individual cities of West St. Paul and South St. Paul would be terminated as parties to the original Dakota County Mutual Aid Fire Services Agreement and name /habilities replaced by the South Metro Fire Department. Amendment No. 1 to the Dakota County Mutual Aid Fin ServacesAgreement clarifies this change do to the merging of the two departments. The consolidation will have no impact to the overall operation of the mutual aid m its current form. SUMMARY It is requested that Council adopt and sign, Amendment No. 1 to the Dakota Mutual Aid Fire Services Agreement AMENDMENT NO. 1 TO THE DAKOTA COUNTY MUTUAL AID FIRE SERVICES AGREEMENT WHEREAS, the Cities of West St. Paul and South St. are in the process of consolidating their fire departments into the South Metro Fire Department; and WHEREAS, both City Councils of West St Paul and South St. Paul have approved of the consolidation and are making strides toward a date at which time the South Metro Fire Department will be fully mtegrated and operational "Operational Date and WHEREAS, the exact date that the South Metro Fire Department will become operational is undetermined, however, it is cntical that the Dakota County Mutual Aid Fire Services Agreement "Agreement seamlessly transfers the liabilities, benefits and obligations to the South Metro Fire Department as of the Operational Date and that the cities of West St. Paul and South St. Paul are terminated as parties to the Agreement as of the Operational Date; and WHEREAS, it is in the best interest of the parties to the Agreement that mutual aid in its current form and operation continue without interruption; and WHEREAS, the most efficient way to accomplish a seamless transfer in the Agreement is to amend the Agreement such that the cities of South St Paul and West St. Paul are replaced by the South Metro Fire Department, effective as of the Operational Date; and WHEREAS, the Cities of West St. Paul and South St. Paul accept all liabilities and obligations accrued by them up to the Operational Date; and WHEREAS, the South Metro Fire Department is willing to accept all liabilities, benefits and obligations from the Operational Date forward. NOW, THEREFORE, THE DAKOTA COUNTY MUTUAL AID FIRE SERVICES AGREEMENT IS HEREBY AMENDED AS FOLLOWS: 1. The Cities of West St Paul and South St. Paul are terminated as parties to the Agreement as of the date that the South Metro Fire Department becomes operational. 2.
