Flint Hills is currently using two similar buildings for office and warehouse space as part of the Utlra Low Sulfur Diesel "Hydrocacker" construction project Those structures were also approved through an IUP in 2004 (Planning Case No 04 -67) which is scheduled to expire on September 1, 2006 Should the City approve this request, Flint Hills would remove one of those buildings and relocate the other for this warehouse use under a new IUP. The new IUP would expire on May 1, 2010. The structure will be 60' wide, 147' long and 26' high (approximately 8,820 square feet) and resemble an oblong dome with a peaked roof. Visibility of the structure should be limited, given the proposed location approximately 0 4 mile from Blaine Avenue and 0.7 mile from Highway 52. PLANNING COMMISSION ACTION The Planning Commission held a pubhc heanng to review this item on May 23, 2006. Draft excerpt minutes for that meeting are attached for your reference Afrer hearing from staff and receiving no public comment during the public heating, the Commission unanimously recommended the City Council approve this IUP request from Flint Hills Resources. BACKGROUND Interim Use Permits are intended to authorize the temporary use of a property for a specific use until a particular date, until the occurrence of a particular event or until zoning regulanon no longer permit the proposed use. The standards and findings necessary for reviewing an IUP application are outlined in Section 11- 10 -08. The City must approve or deny each IUP request based on findings related to these cntena. Staff's review and findings for these cnteria are outlined below. Should the City approve an IUP request, it may attach conditions to mitigate anticipated adverse impacts associated with the use, ensure compliance with the standards of approval, protect the value of other property, and achieve the goals and objectives of the comprehensive plan. Standards 1. The intenm use must be allowed in the zoning distract where the property is located. Finding. The subject property is zoned GI General Industrial and Temporary Buildings'are listed as an interim use in this district. 2. The interim use must meet or exceed the performance standards set forth in this title and other applicable City ordinances. Finding: Section 11- 4 -16.D, grants the City the authonty to waive performance standards for building materials, off street parking, and site landscaping but specially requires a 500 foot setback from adjoining public nghts -of -way and public, institutional or residential uses or districts or a sufficient screen from these items. Given the 0 4 mile setback from Blaine Avenue and 0.7 mile setback from Highway 52, staff finds the City may waive the building materials, off street parking, site landscaping and screening standards for this temporary building. All other applicable standards remain in effect, includmg the requirements of the City Engineer and Fire Marshal. Specifically, the Fire Marshal requires the site have a fire hydrant capable of supplying the required fire flow for fire protection as well as a fire access road (see attached memo dated May 4, 2006). 3. The intenm use must comply with the specific standards for the use identified in this title, and must comply with all conditions of approval which shall be included in an IUP agreement. Finding As mentioned above, Section 11- 4 -16.D, grants the City the authority to waive performance standards for building matenals, off street parking, and site landscaping but requires a 500 foot setback. Given the large setbacks for the proposed temporary use, staff finds the City may waive the performance standards mentioned above. All other applicable standards remain in effect. Findings 1. The extent, location, and intensity of the use will be in substantial compliance with the comprehensive plan. Finding: The Comprehensive Plan idennfies the subject property as GI General Indusrrial. 2 Staff finds the proposed 60' wide, 147' long and 26' high temporary warehouse use consistent with this designation 2. The use will provide adequate ingress and egress to minimize traffic congestion in the public streets. Fmdmg. The site will have access from Refinery 12 Street which in turn has access to the refinery's main gate and public streets. 3. The use will not be detrimental to the existing character of the development in the immediate neighborhood or endanger the public health, safety, and general welfare. Finding: The proposed temporary warehouse use is consistent with the GI General Industrial zoning and land use classification as well the surrounding refinery activity According to the applicant, this warehouse will store instrumentation, electrical equipment, insulation and the like which should not endanger the public health, safety or general welfare. 4. The use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district. Finding: The proposed temporary building is part of Flint Hill's capital improvement plan and therefore will not impede the normal and orderly development of the area. 5. The use shall, in all other respects, conform to the applicable regulations of the district in which it is located. Finding: The subject use is consistent with the GI General Industrial land use and zoning classifications. Given its design and remote location within the refinery site, staff finds the City may waive the loading, building materials, trash enclosure, landscaping, signage, and lighting standards. Should the applicant wish to alter any of these items they would first need to amend this mterum use permit. All other applicable standards remain m effect, including the requirements of the City Engineering and Fire Marshal. CONCLUSION RECOMMENDATION Staff recommends approval of the IUP request from Fhnt Hills Resources, LP to allow the assembly of a temporary "sprung steel" building for warehousing and storage for two capital projects within the Refinery site until 2010. This recommendation is based on the plan submitted by the apphcant, the findings made m this report, and are subject to the conditions outlined in the recommended actions secnon above. 3 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2006 A RESOLUTION APPROVING THE INTERIM USE PERMIT (IUP) FOR FLINT HILLS RESOURCES, LP TO ALLOW THE ASSEMBLY OF A TEMPORARY "SPRUNG STEEL" BUILDING FOR WAREHOUSE /COLD STORAGE WITHIN THE REFINERY SITE UNTIL MAY 1, 2010 WHEREAS, the Community Development Department of the City of Rosemount received an application from Flint Hills Resources, LP requesting an Interim Use Permit (IUP) to allow the assembly of a temporary "sprung steel' building for warehouse /cold storage until May 1, 2010 located on property owned by Flint Hills Resources approximately 1/2 mile east of County Road 71 and one mile north of 140 Street in Rosemount, legally described as follows: SECTION 24 TWN 115 RANGE 19, S' /4 OF NW 3/4 LESS 6.45 A RR &EXS 1 OFNEW "/4 OF NW 1/4 WHEREAS, on May 23, 2006, the Planning Commission of the City of Rosemount held a pubhc hearing to review this item; and WHEREAS, the Planning Commission adopted a motion to recommend that the City Council approve the Interim Use Permit for the assembly of a temporary warehouse building located on Flint Hills Refinery Land based on the following findings of fact: 1. Temporary buildings are a permitted interim use in the GI- General Industrial District. 2. Given the temporary nature of the use and the proposed setbacks, the City waives the building materials, off street parking, site landscaping and screening standards for this temporary building All other applicable standards remain in effect, including the requirements of the City Engineer and Fire Marshal. Specifically, the Fire Marshal requites the site have a fire hydrant capable of supplying the required fire flow for fire protection as well as a fire access road (see attached memo dated May 4, 2006). 3. RESOLUTION 2006 NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Intenm Use Permit for the relocation of an existing temporary warehouse building located on Flint Hills Refinery Land, subject to the following conditions: 2. Conformance with all conditions outlined in the attached Interim Use Permit for 2006 through 2010. ADOPTED this 20th day ofJune, 2006 by the City Council of the City of Rosemount ATTEST: Amy Domeier, City Clerk William H Droste, Mayor Motion by: Second by: Voted in favor: Voted against: Member absent. 2 2006 -10 Interim Use Permit Conditions for Relocation of a Temporary Warehouse Building Temporary Buildings located in the GI General Industrial District This Interim Use Permit (IUP) is valid only for the property legally described on Attachment 1, attached to this document. 1. This permit shall be in effect for the calendar years of 2006, 2007, 2008, 2009, and expire on May 1, 2010. 2. The City may revoke this permit should the property owner receive approval to redevelop this site in the future. 3. This permit shall be reviewed prior to renewal in 2010 for conformance with these conditions. Thereafter the City Council will determine the appropriate time interval for the subsequent renewal procedure. 4. Violation of any specified IUP condition or otherwise unlawful activity may result in immediate revocation of the IUP. 5. All site improvements shall be reviewed by the City Engineer for approval prior to completion in accordance with City standards including grading permits. 6. All permits required by other applicable agencies must be obtained and copies submitted to the City. 7. All development and dimensional standards of the zoning ordinance apply to future improvements with the exception of paving requirements. 8. Parking areas must consist of a minimum of six (6) inches of compacted, crushed limestone or other such material acceptable to the City Engineer, and shall be maintained accordingly. 9. Conformance with all requirements of the City of Rosemount Fire Marshal including, but not limited to a fire hydrant capable of supplying the required fire flow for fire protection as well as a fire access road. Project Description for the City of Rosemount Interim Use Permit Application Warehouse structure for the #3 Crude Unit Revamp Project Flint Hills Resources (FHR) proposes to relocate an existing structure, currently located on the FHR refinery site, to a new, on site location so that it can be used as a cold storage warehouse to support two planned capital projects. This existing structure is currently being used as a warehouse facility for the recently completed Ultra Low Sulfur Diesel Project. The structure was manufactured by Sprung Instant Structures (see attached drawings) and it was erected on site in December 2004. FHR received a building permit from the City of Rosemount for this structure. Please reference City of Rosemount Building Permit No. 0403110. This structure was to be dismantled by late summer 2006 but we would like to dismantle it and reuse it in a different location. It is proposed that this structure be relocated within the refinery to a location just south of the westem -most crude tank (see Refinery aerial map, drawing 4020510) The new location will not be readily visible from Highway 52 from the east or from County 71 from the west. This new location is in an area of the plant where stormwater runoff is covered under the Facility NPDES Waste Water Permit (see drawing, Figure 2A). The only utility needed for the building is electric power for lighting and vent fans. This structure will be used as a cold storage warehouse facility for two upcoming capital projects and will be used from July 2006 through May 2010. Specifically, the #3 Crude Unit Revamp Project will use the structure in 2006 2007 and the Coker Project will use the structure in 2008 through spnng 2010.
