As provided m Minnesota Statute 282.01, the City has the authority to approve the transfer of tax- forfeited property by one of three means, the auction of this property to the public, the auction of the property to the adjacent owner(s), or the conveyance to the City for pubhc use. BACKGROUND The City has been notified that the State of Minnesota has acquired a parcel at the intersection of Cardinal St. W. and Cicerone Path through tax- forfeiture The parcel mformation regarding this property is as follows: PID Property Owner: Location. Guide Plan Desig: Current Zoning: City Council Action: CITY COUNCIL EXECUTIVE SUMMARY 34- 30250- 010 -00 State of Minnesota Directly West of the Intersection of Cardinal St. W. and Cicerone Path Outlot A, Geromme Pond 0.04 Urban Residential R -1, Low Density Residential Approved Final Plat June 3, 1997 It appears that this parcel was created as a remnant parcel when the right -of -way for Cicerone Path was acquired during the platting of Geromme Pond. Geromine Pond was platted in 1997; Cardinal St. W. had been previous platted the year prior as a part of Shannon Pond East Addition Since Cardinal St W. was an existing condition, the alignment of Cicerone Path created a small piece of remnant land to the west of the intersection of Cardinal St W and Cicerone Path. Apparently, property taxes have not been paid on this remnant, and as such, the State acquires this property through tax forfeiture. Now, the City has three choices on how to transfer this property; the auction of this property to the public, the auction of the property to the adjacent owner(s), or the conveyance to the City for public use. Staff discourages the public auction of this property. The property is described as an Outlot, and is considered unbuildable. If it was purchased by anyone other than an adjacent property owner, a would be unusable without a variance, and a variance would not likely be granted by the City due to its limited size and dissimilarity with the other lots within the neighborhood Staff does not see a pubhc use for this property, so staff also discourages the conveyance of this property to the City. Its hmited size does not provide any recreational uses and the Right -of -Way surrounding this property is sufficient for all the public infrastructure needs of the neighborhood. City ownership would also prevent any future tax income from this property. Staff believes the best option for this property would be the auction of this property to the adjacent owner. There is only one property adjacent to this parcel, which is described below: PID Location: Legal Descnpuon: Area m Acres. Comp. Guide Plan Desig: Current Zoning: City Council Action: The adjacent property is actually non conforming m size for a corner lot The R -1 Zoning District requires corner lots to be 12,000 square feet in size, which is approximately 0.28 acres in size By acquiring this Outlot, together the two parcels would be 0.29 acres m size. The other lots on the block are between 0.24 and 0 32 acres in size. Staff believes that the best use for this property would be the sale of this property to the adjacent owner. Lot 5, Block 3, Shannon Pond East Addition 0.25 Urban Residential R -1, Low Density Residential Approved Final Plat July 2, 1996 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2006 A RESOLUTION TO AUTHORIZE THE DAKOTA COUNTY TREASURER AUDITOR TO AUCTION TAX FORFEITED PARCEL 3430250 010 -00 TO THE ADJACENT OWNER(S) WHEREAS, the State of Minnesota has acquired the parcel with PID 34- 30250- 010 -00 through tax forfeiture; and WHEREAS, Minnesota Statute 282.01 states that the City shall determine the method of transfer of tax forfeit property through one of three means; the auction of this property to the public, the auction of the property to the adjacent owner(s), or the conveyance to the City for public use; and WHEREAS, the Dakota County Treasurer- Auditor has requested the City to determine the means of transfer m a letter dated May 16, 2006, and WHEREAS, the City has determined that best use of the property would be by the adjacent property owners. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby authorize the Dakota County Treasurer- Auditor to auction tax forfeited parcel 34- 30250- 010 -00 to the adjacent owner(s) only: ADOPTED this 20th day of June, 2006 by the City Council of the City of Rosemount.
