EXECUTIVE SUMMARY
BACKGROUND:
As a part of the Endres Property final plat, all existing drainage and utihty easements across the property
will be vacated. After development these easements will be considered obsolete following development
and re- grading of the site Should Council approve vacation of these easements, new temporary easements
will be drawn up over the same areas described by the existing drainage and utility easements such that use
and access to easements will exist and be permitted as it currently does When development occurs, these
temporary easements will expire, the final plat will reflect the final development concept, and new drainage
and utility easements will be recorded as a part of the final plat coinciding with the new development
pattern
The legal descnption of the Endres Property easements to be vacated has been reviewed by Staff and the
attachment displays the easements as described
SUMMARY:
Staff recommends that Council adopt a resolution vacating the easements described in the attached exhibit
on the Endres Property.

WHEREAS, a pubhc hearing was scheduled and held before the City Council of the City of Rosemount on
July 11, 2006 after due pubhcation as required by law, and all interested persons were given an opportunity
to be heard, and
WHEREAS, it appears the current easement serving a pubhc purpose is based upon the property in a
predevelopment state, and will be replaced by a modified easement for public purpose that will be
incorporated with the development plat.
NOW THEREFORE BE IT RESOLVED, that the following easement hereby vacated, to wit.
Vacate all drainage easements and drainage and utility easements over, under, and across Lot 1,
Block 1, ENDRES PROPERTIES ADDITION, according to the recorded plat thereof, Dakota
County, Minnesota.
BE IT FURTHER RESOLVED, that the City Attorney shall prepare a notice of completion of the
proceedings and necessary Quit Claim Deeds which shall contain the name of the City, identification of the
vacation and a statement of the time of completion thereof, and shall present the same to the County
Auditor and then file a copy with the County Recorder.
