The Item was reviewed by the Planning Commission in June and a pubhc hearing was held. The item is scheduled elsewhere on the Council agenda tonight. Attached is a copy of the letter sent to Mr Napper on Friday, July 14, 2006, who also received the Council packet with the mailing. July 14, 2006 Myron Napper 3381 145` Street E Rosemount, MN 55068 Re: Shafer Mineral Extraction Permit Dear Mr. Napper: This letter is in response to your concerns that the Shafer Mineral Extraction Permit revision would allow inappropriate material to be brought into the Shafer site. The following information was provided by Shafer as part of itsr application and addresses your concerns about clean fill. As was mentioned at the Council meeting, Shafer will be paying for a testing firm to ensure that these standards are met. The haul -back material will be clean fill soil only, not concrete, asphalt, or any other form of construction debris. The haul -back matenal will come from only MnDot projects that have conducted Phase I and Phase II Environmental Site Assessments (ESA). MnDot construction projects require that the native soils at a construction site be removed to form a trench under the future roadway, sometimes four or more feet deep, to allow the placement of approved and compacted sub -base material. This material removed to form this trench is the matenal that would be hauled back to the Shafer site. Additional testing, including laboratory analysis and field screening with a photoioruzation detector (PID), will be conducted when the ESAs indicate any concerns. Haul -back material shall not contain any contamination or hazardous material. Haul -back matenal shall not contain any debns, refuse, or other deleterious matenal. Organic soil would only be used for berms or green areas. Shafer will supply a quarterly report of all haul -back activities based on the testing conducted as described in the approved protocol. Shafer will report to the City, within three days, any occurrence of testing that identifies any contamination or prohibited materials The City will be able to identify any prohibited haul -back material and have it removed from the site. The Amencan Engineering Testing, Inc. protocol and the conditions within the Revised Mineral Extraction Permit spell out clearly that only clean fill soil from MnDot sites that have been environmental tested will be allowed, as well as spell out how this will be monitored. The submitted reports will be pubhc information and any residents can request to review them if they are concerned A copy of the revised permit and staff report scheduled for Council action at the meeting on July 18, 2006 is attached for your information.
