ATTACHMENTS: Resolution APPROVED B yr the reques �y Man Lot 2, Block 1 of Twin RECOMMENDED ACTION: Motion to adopt a Resolution denying Land Development to release the conservation easement upon Ponds. 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: October 3, 2006 EXECUTIVE SUMMARY ISSUE At their September 19, 2006 meeting, the City Council tabled the request to release the conservation easement upon Lot 2, Block 1 of Twin Ponds and directed staff to prepare findings for denial. The attached Resolution provides the requested findings. RECOMMENDATION Adopt a Resolution denying the request by Manley Land Development to release the conservation easement upon Lot 2, Block 1 of Twin Ponds. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2006- A RESOLUTION DENYING THE REQUEST BY MANLEY LAND DEVELOPMENT TO RELEASE THE CONSERVATION EASEMENT UPON LOT 2, BLOCK 1 OF TWIN PONDS WHEREAS, the City of Rosemount received a request from Manley Land Development requesting the release of the conservation easements for property legally described as. Lot 2, Block 1, Twm Ponds, Dakota County WHEREAS, it is the intent of Manley Land Development to dedicate a new conservation easement that would allow wetland buffer averaging to decrease the buffer width near the budding pad to less than 75 feet; and WHEREAS, the City of Rosemount has adopted the Comprehensive Wetland Management Plan (Wetland Plan) that identified the wetlands on Lot 2, Block 1 of Twm Ponds as preserve wetlands requiring a 75 foot wide wetland buffer; and WHEREAS, on October 18, 2005, the City of Rosemount obtained a conservation easement to provide the wetland buffer as a condition of the Twin Ponds subdivision, and WHEREAS, Lot 2, Block 1 of Twin Ponds is a buildable lot with the conservation easement; and WHEREAS, the area of the conservation easement of Lot 2, Block 1 of Twin Ponds has steep slopes, sometimes in excess of 15 and is naturally vegetated with trees and undergrowth; and WHEREAS, the Wetland Plan states that native vegetadon is the optimal condition for an effective wetland buffer; and WHEREAS, a goal of the Wetland Plan is to avoid direct or indirect impacts from activities that destroy or dururush the quantity, quality, and biological diversity of wetlands, and WHEREAS, the Wetland Plan has a management strategy to apply strict avoidance standards for preserve wetlands; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby denies the release of the conservation easement upon Lot 2, Block 1 of Twin Ponds. ADOPTED this 3rd day of October, 2006 by the City Council of the City of Rosemount. William H.
