EXECUTIVE SUMMARY
ISSUE
Great River Energy has purchased a 79.32 acre parcel of land from Pine Bend Development Company.
The property is spht by Ehlers Path and would end up being two lots of 4.06 and 75.26 acres respectively.
As with most lot sphts, it is considered a subdivision and would be subject to the City's Subdivision
Ordinance.
BACKGROUND
Great River Energy has purchased about 332 9 acres of land from Pine Bend Development Company, a
large landowner east of U.S. 52. The land consists of six large parcels of which portions of two extend
beyond the purchase area, the area north of Ehlers Path. The southern property is intended for the future
construction of a power plant. The tmnng for the power plant construction has been delayed from what
was initially anticipated and the new construction tnneframe is now in the 5 -10 year range. Originally this
topic was brought to the Parks and Recreation Commission as two lot splits but they actually only need
one.
This item was originally discussed at the May 23, 2005 Parks and Recreation Commission meeting. At the
May meeting, the Commission recommended collecting cash in heu of land for the parks dedication based
on the City's Fees and Fee Policy.
SUMMARY
GRE has met with staff to raise issue with the cash dedication amount based on our Fee Policy. GRE has
stated that they paid $15,000 per acre a couple of years ago and they feel that $50,000 per acre is an unfair
amount based on state statute calling for parks dedication fees to be based on the fair market value at the
time of final approval.
Staff have had several discussions with representatives from GRE regarding the parks dedication fees. The
Parks and Recreation Commission (on a 4 -1 vote) recomiended that we collect 5180,000 ($180,000
divided by 7.9 acres $22,784 per acre) for the parks dedication fee for the GRE lot split. The reasons
for collecung a fee that is less than what is in our approved Fee Pohcy are that the land is currently zoned
for agriculture, the value of the land is less than properties currently developing on the west side of
Highway 52 and our subdivision ordinance allows us the flesibihry to review all subdivisions on a case by
case basis Staff also supports the recommendation of the Parks and Recreation Commission.
