Z.C, ATTACHMENTS: Location Map, Parcel Split APPROVED BY% v, l RECOMMENDED ACTION: None 4 ROSEMOUNT CITY COUNCIL City Council Workshop: February 14, 2007 EXECUTIVE SUMMARY BACKGROUND In July 2006 the City Council approved a lot spht requested by Great River Energy. One of the conditions was dedication of 100 feet of nght of way for Ehlers Path This would have required dedication on both sides of the division line, with GRE only controlling the southern parcel. It is staff's understanding that the property owner of the northern parcel did not want to dedicate right of way; this refusal has not allowed the lot spht to be recorded. GRE is proposing that they dedicate right of way for Ehlers Path on the adjoining 80 acres which they also purchased and divided. This parcel was not subject to City action because it was exempt by State law from municipal subdivision regulations Staff is comfortable with the change as the City needs to obtain right of way over all portions of Ehlers Path. Staff wanted to update the Council on this change prior to banging an amended resolution before the Council for action.
