PLANNING COMMISSION RECOMMENDATION
During theft January 23, 2007 meeting, the Planning Commission conducted a public hearing and recommended
approval of the prelmnnary and final plat One resident, Debra Zippel, spoke during the public hearing Mrs.
Zippel lives at 14300 Cameo Avenue, on the southeast corner of Cameo Avenue and 143' Street and directly
behind the St Joseph's access to 143" Street. Mrs. Zippel expressed concern about a six foot wide parcel
between her property and St Joseph, the future use of St. Joseph's School, and the landscaping and buffering
between the library and her neighboring properties. Staff explained to her that St. Joseph had transferred clean
titles to the City of all of their property, included the six foot wide parcel; the future use of St. Joseph's School
will be determined by the St. Joseph's task force and the City Council; and that site plan for the library will be
discussed at the January 29 open house and at a future Planning Commission meeting. The future Planning
Commission meeting will include a public hearing and individual notices will be mailed per the City Ordinance.
ISSUE
The City is requesting approval of a preliminary and final plat for the library site. The 4.32 acre site is currently
compnsed of eight lots. The plat creates two lots; one of which will be deeded to the County for construction of
the library and one will be retained by the City.
BACKGROUND
The City acquired the St. Joseph's church property in 2004 to provide land for a new Dakota County
Library. The County requires the City to dedicate the land and the County pays for construction of the
facility. Design for the Library is underway and the concept designs were unveiled at a public meeting on
January 29, 2007.
DISCUSSION
The 4.32 acre plat is located within the Downtown area and is zoned a combination of PI Pubhc /Institutional
and R1A Low Density Residential. The residential zonmg and guide plan are located on the western portion of
the property, on the lots fronting Cameo Avenue It is unclear why the guide plan and zoning were not
previously changed to reflect the church use on the entire site. Staff will look to adjust these designations dunng
the Comprehensive Plan update process.
Lot 1 is 1.87 acres and Lot 2 is 2.45 acres. There is no minimum size required in the Pubhc Institutional zoning
district. The plat depicts appropnate lot line drainage and utility easements as prescribed by the Subdivision
Ordinance. Any future pondmg on -site would not be regional m nature and therefore no additional easements
are necessary.
As part of the site plan design, there have been discussions with MnDot regarding the appropriate location for
access. The City has not received final comments from MnDot regarding the plat although expect that the access
point proposed m the concept will be acceptable A secondary access will be from Cameo Avenue which is
under City regulation.
RECOMMENDATION
Staff recommends approval of the Kilcutnreragh Addition preliminary and final plat.

WHEREAS, the City of Rosemount requested Prehnunary Plat and Final Plat approval
concerning property legally descnbed as:
Lot 26, Auditors Subdivision No. 1 Rosemount, Dakota County, Minnesota.
And
That part of Lot 25, Auditor's Subdivision No. 1 Rosemount, Dakota County, Minnesota,
described as follows: Commencing at the Southwest corner of Lot 26, Auditors Subdivision
No. 1; thence East along the South hne of said Lot 26, 182.4 feet, more or less, to the
Westerly line of the highway; thence Southerly along the Westerly hne of said highway 114.9
feet; thence West 212.3 feet to a point 110 feet Southerly of the point of begmnmg; thence
Northerly to the point of beginning
And
Lot 25, Auditor's Subdivision No. 1 Rosemount, Dakota County, Minnesota, except that

RESOLUTION 2007-
WHEREAS, on January 23, 2007, the Planning Commission of the City of Rosemount held a
pubhc heanng and reviewed the Preliminary Plat and Final Plat for Kilcumreragh Addition; and
WHEREAS, on January 23, 2007, the Planning Commission recommended approval of the
Preliminary Plat and Final Plat; and
WHEREAS, on February 6, 2007, the City Council of the City of Rosemount reviewed the
Planning Commission's recommendations; and
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Preliminary Plat and Final Plat for Kilcumreragh Addition.
ADOPTED this 6th day of February, 2007, by the City Council of the City of Rosemount.
