EXECUTIVE SUMMARY
SUMMARY
Ryan McGunnigle, Edward McMenomy, Jr. and Anne McMenomy, officers of Las Tortillas Mexican
Restaurant, Inc. together submitted an Application for an On -Sale Liquor License Class B and a Special
Sunday Liquor License for Las Tortillas Mexican Restaurant located at 15051 Crestone Avenue. The
application was accompanied by the necessary corporate documents and investigation fee. Staff will work
with the applicants to obtain the required liquor liability insurance, workers compensation insurance, and
license fees. The liquor licenses will require review of the application materials, an on -site inspection and
final approval by the Minnesota Department of Public Safety.
Per City Code, Class B liquor licenses may only be issued to hotel and restaurants where fifty -one percent
(51 or more of total revenues are derived from the sale of food and nonalcoholic beverages for
consumption on the premises during hours when the sale of alcoholic beverages is allowed. During the
liquor renewal process in 2011, the applicants will be required to submit a statement signed by an
independent certified public accountant attesting that 51% or more of the total revenues were derived
from the sale of food and nonalcoholic beverages for the preceding 12 months.
The Police Department conducted a background check of the applicants. Based upon information learned
in the background investigation, staff believes the applicants meet the City's standards for issuance of a
license.
RECOMMEADATION
Upon holding the public hearing, Staff recommends approval of the On -Sale Liquor License Class B and
Special Sunday Liquor License for Las Tortillas Mexican Restaurant, Inc. DBA Las Tortillas Mexican
Restaurant for the premise located at 15051 Crestone Avenue, Rosemount subject to receiving a
Certificate of Occupancy from the Chief Building Official.
