ATTACHMENTS: Agreement APPROVED BY: RECOMMENDED ACTION: Motion to approve the Police Liaison Services Agreement between the City of Rosemount and School District #196 for the 2011 2012 school year. BACKGROUND The Police Department provides police liaison services at District #196 schools within the City. An officer is assigned full-time (40 hours per week) at Rosemount High School and .25 time at Rosemount Middle SchooL ISSUE District #196 provides funding to the City for the providing of liaison services at the two public schools. In addition to the liaison services, an officeY also spends one to two hours per week at each of the public elementary schools. The City does not receive funding from the District fox the services provided at the elementary schools. These services are offexed to pxovide assistance with some educational programming and to develop positive relationships with students. RECOMMENDATION Staff tecommends that Council approve the agreement fox police liaison services for the 2011 2012 school yeaY. The amount specified in the agreement was verified in conversation with representa.tives of your police department. The Minnesota Legislature has maintained the same amount of funding per pupil for the "Safe Schools Levy" as last year. We have provided the local police departments who work with District 196 an increase in funding of 1%. RECITALS WHEREAS, the parties enter into this Agreement pursuant to Minnesota Statutes §126C.44. WHEREAS, for purposes of this Agreement, the School District's participating secondary schools within the City consist of the following schools: Rosemount Middle School and Rosemount High School; and NOW THEREFORE, the parties hereto agree as follows: 1. The City agrees to provide a state certified police officer to perform 40 hours per week police liaison service at the School District's secondary high school and 10 hours per week at the School District's middle school for the purpose of assisting in the establishment and trained coordination of a cooperative community approach among the School District's schools, students, parents, police and other community resources to address the needs of the students and community members. The City's police liaison services shall include, but not limited to: a. Prevention of delinquency; b. Protection of life and property; and c. The parties agree and acknowledge that the police of�cers who are assigned to provide police liaison services in the schools are, and will continue to be, members and employees of the City and its police department. The police officers shall not become an agent or employee of the School District by virtue of this Agreement and shall not make any representations to the contrary. The o�cers shall operate under the direct administration and supervision of the police department but will work in cooperation with school administrators to further mutually agreed goals involving the police department, schools and students. The officers shall not have disciplinary authority within the schools or be considered educational service providers, but shall be limited to their police functions. 4. The amount to be paid by the School District as speci�ed in Paragraph 2 herein shall be payable for the 2011-2012 school year upon approval of this Agreement by both parties. 5. This Agreement is effective for the 2011-2012 school year; upon the expiration of the 2011-2012 school year, this Agreement shall automatically terminate. 6. Each party shall be liable for the acts and omissions of its own agents and employees and not the acts and omissions of the other party's agents and employees. The parties' liability shall be limited by the provisions of the Municipal Tort Claims Act, Minn. Ch. 466 or other applicable law. 7. The parties agree that all government data collected, shared or received as a result of the parties' duties under this Agreement shall be handled and maintained in accordance with all applicable federal, state and local laws, rules and regulations governing government data, including, but not limited to the provisions of the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13. The parties understand and agree that any sharing of data between them must occur in accordance with the law governing the dissemination of data, including, but not limited to, speci�c laws and governing the sharing of data on students and minors.
