RECOMMENDED ACTION: Motion to adopt a resolution approving vacation of the
drainage and utility easements over Outlot A, Glendalough 3' Addition, subject to
conditions.

Development (PUD)
The applicant, U.S. Homes, requests vacation of the drainage and utility easements over Outlots A,
Glendalough 3rd Addition. Vacation of this easement is necessary to subdivide portions of Outlot A,
Glendalough 3' Addition into twenty five (25) new single family lots to be known as Glendalough 4''
Addition. Staff recommends approval of this request.
PREVIOUS ACTION
The Planning Commission reviewed the Glendalough 4`' Addition final plat during their regular meeting
on March 22, 2011. By Ordinance, no public hearing is required for final plats and staff and the Planning
Commission found the proposed final plat in compliance with the original preliminary plat. As a result,
the Commission recommended the City Council approve this item.
ISSUE ANALYSIS
By Statute, easement vacations require a public hearing and approval by the City Council. As a matter of
course, the City places drainage and utility easements over all outlots. When these oudots are subdivided
into future development, the easement must be vacated to allow creation of the new final plat. In this
case, the drainage and utility easements over Oudot A, Glendalough 3' Addition must be vacated to allow
creation of the Glendalough 4` Addition.
RECOMMENDATION
Staff recommends conducting a public hearing and then adopting a resolution approving vacation of the
drainage and utility easements over Oudot A, Glendalough 3rd Addition to allow creation of Glendalough
4` Addition.

RESOLUTION 2011 -
A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY
EASEMENTS OVER OUTLOT A, EVERMOOR GLENDALOUGH
3 RD ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from U.S. Home Corporation requesting Final Plat concerning Outlot A, Evermoor
Glendalough 3rd Addition creating 25 new single family lots known as Glendalough 4th Addition,
legally described as:
Lots 1 —14, Block 1, and Lots 1 -11, Block 2, Glendalough 4th Addition, Dakota County, Minnesota.
WHEREAS, on March 22, 2011, the Planning Commission of the City of Rosemount reviewed the
Final Plat for Glendalough 4th Addition; and
WHEREAS, the Planning Commission adopted a motion to recommend that the City Council
approve the Final Plat subject to conditions; and
WHEREAS, the vacation of the existing drainage and utility easements over Outlot A, Evermoor
Glendalough 3rd Addition is required before the Final Plat can be recorded for Glendalough 4th
Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on April 19,
2011.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Vacation of the Drainage and Utility Easements over Outlot A, Evermoor
Glendalough 3rd Addition, legally described as:
A drainage and utility easement vacation over, under, and across all that part of Outlot A,
Evermoor Glendalough 3rd Addition, according to the recorded plat thereof, Dakota
County, Minnesota;
subject to:
1. The Vacation of the Drainage and Utility Easements over Outlot A, Evermoor
Glendalough 3rd Addition is effective only upon the recording of the Final Plat of
Glendalough 4th Addition.
ADOPTED this 19th day of April, 2011, by the City Council of the City of Rosemount.
