Funding Summary APPROVED BY: obi RECOMMENDED ACTION: 1) Motion to Adopt a Resolution Setting a Public Hearing for Improvements on the Proposed 2011 Street Improvements Project, City Project #432 And 2) Motion to Adopt a Resolution Declaring Costs to be Assessed and Ordering Preparation of Proposed Assessment and Calling for Hearing on the Proposed Assessment for the 2011 Street Improvements Project, City Project #432. 4 ROSEMOUNT City Council Meeting: April 5, 2011 BACKGROUND: CITY COUNCIL EXECUTIVE SUMMARY On January 4, 2011 the Rosemount City Council received the Feasibility Report for the 2011 Street Improvements Project. This project has been designated as City Project #432. A full presentation of the Feasibility Report and the proposed improvements contained within will be made at the Public Hearing. A brief review of the proposed improvements and funding follows. 1. LOCATION AND PROPOSED IMPROVEMENTS The 2011 Street Improvement Program Project includes the following: Mill and overlay of 145 Street West from Diamond Path to Shannon Parkway (0.5 miles) New sidewalk installation on north side of 145 Street West from Diamond Path to Shannon Parkway (0.5 miles) Roadway rehabilitation of streets within the west half of the Valley Oak neighborhood (0.9 miles) The attached location map illustrates the proposed project areas. 2. ESTIMATED COSTS AND FUNDING The total estimated project cost for the 2011 Street Improvement Project is $1,207,736. The project is proposed to be funded as follows: Street CIP Fund $851,535 Special Assessments $257,532 Storm Utility Fund 37,564 Street Maintenance Fund 61,105 $1,207,736 G: \ENGPROJ \432 \20110405 CC SetPH- DeclareCostAssessment.doc SUMMARY: Staff recommends Council adoption of a resolution setting the public hearing for the 2011 Street Improvements Program Project, City Project #432, for May 3, 2011. Additionally, Staff recommends as a separate action, Council adoption of a resolution declaring the costs to be assessed and setting a public assessment hearing for City Project #432, for May 3, 2011. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2011 A RESOLUTION SETTING A PUBLIC HEARING FOR IMPROVEMENTS ON THE PROPOSED 2011 STREET IMPROVEMENTS PROJECT CITY PROJECT #432 WHEREAS, the feasibility report for the 2011 Street Improvements Project, City Project 432 was received and plans and specifications were ordered on January 4, 2011; and WHEREAS, the plans and specifications were approved and the advertisement for bids was authorized on March 15, 2011; and WHEREAS, the statute provided that no such improvements shall be made until the Council has held a public hearing on such improvements following mailed notice and two publications thereof in the official newspaper stating time and place of the hearing, the general nature of the improvement, the estimated costs thereof, and the area proposed to be assessed, in accordance with the law. NOW THEREFORE IT BE RESOLVED, by the City Council of the City of Rosemount that the public hearing be scheduled to consider City Project 432, 2011 Street Improvements Project, to be held on Tuesday, May 3, 2011 at 7:30 o'clock p.m. or as soon thereafter as possible, in the Council Chambers of the City Hall and that the publication of notice thereof is hereby approved and ratified. ADOPTED this 5 day of April, 2011. ATTEST: Amy Domeier, City Clerk William H Droste, Mayor CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2011 A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT, AND CALLING FOR HEARING ON THE PROPOSED ASSESSMENT 2011 STREET IMPROVEMENTS PROJECT CITY PROJECT #432 WHEREAS, a hearing has been scheduled for the 2011 Street Improvements Project and the estimated construction cost for such improvement is $979,779, and the estimated expenses to be incurred in the making of such improvements amount to $227,957 so that the total cost of the improvement will be $1,207,736. NOW, THEREFORE, BE IT RESOLVED, by the City Council of Rosemount, Minnesota: 1. The portion of the cost of such improvement to be paid by the City is hereby declared to be $950,204. The portion of the cost to be assessed against benefited property owners is declared to be $257,532. 2. Assessments shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable with general taxes for the year 2011, and shall bear interest at the rate of 2% points per annum above the interest rate paid by the City for its bonds from date of the adoption of the assessment resolution, or 2% over our financial consultant's estimated true interest cost (TIC) for a 10 -year bond transaction for the City of Rosemount issued in April /May of this year. 3. The City Clerk, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and she shall file a copy of such proposed assessment in her office for public inspection; and BE IT FURTHER RESOLVED by the City Council of Rosemount, Minnesota: 1. A hearing shall be held on Tuesday, May 3, 2011 in the Council Chambers at 7:30 p.m. or as soon thereafter as possible, to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. Publication by the City Clerk notice of the hearing on the proposed assessment once in the official newspaper at least two weeks prior to the hearing, stating in the notice the total cost of the improvement is hereby approved and ratified. Mailed notice to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings is also approved and ratified. BE IT FURTHER RESOLVED by the City Council of Rosemount, Minnesota: ADOPTED this 5 day of April, 2011. ATTEST: The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The owner may at any time thereafter, pay to the County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made.
