Minutes of the March 15, 2011 Regular Meeting ProceedingsROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS MARCH 15, 2011 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, March 15, 2011, at 7:30 p.m. in the Council Chambers at City Hall, 2875 145 Street West, Rosemount. Mayor Droste called the meeting to order with Council Members Shoe Corrigan, Weisensel, DeBettignies and Kearney attending. Staff members present included City Administrator Johnson, City Attorney LeFevere, Community Development Director Lindquist, City Engineer Brotzler, Police Chief Kalstabakken, Communications Coordinator Cox, and Recording Secretary Hanson. The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO THE AGENDA City Administrator Johnson stated there were no additions or corrections to the agenda. Motion by Droste to adopt the Agenda. Second DeBettignies. Ayes: 5 Nays: 0. Absent: 0. Motion carried. PRESENTATION, PROCLAMATIONS AND ACKNOWLEDGEMENTS a. Police Officer Oath of Office. New City of Rosemount Police Officer Joshua Swenson took the oath of office. b. Recognition of Irish Dance International Competitor Mayor Droste recognized Evan Lowe for his success in competitions for Irish Dance, and in support of his efforts at the world championships in Dublin this spring. Evan is a freshman at Rosemount High School. c. Application for Formal Beyond the Yellow Ribbon Recognition The Beyond the Yellow Ribbon campaign is intended to support service personnel and their families while deployed and after returning home. City Administrator Johnson introduced Don Sinnwell, who is leading the Beyond the Yellow Ribbon committee, and requested a motion to approve the application to become an officially designated community. Mr. Sinnwell gave a brief presentation on the goals and accomplishments of the Beyond the Yellow Ribbon committee. Mr. Sinnwell stated they are looking for more core committee people to help with future projects. Motion by Shoe Corrigan to approve the resolution supporting an application for Rosemount to become officially designated a `Beyond the Yellow Ribbon" community by the State of Minnesota. Second by Weisensel. Ayes: DeBettignies, Shoe Corrigan, Droste, Weisensel, Kearney Nays: None. Absent: 0. Motion carried. (Resolution 2011 -15). PUBLIC COMMENT There was no public comment. CONSENT AGENDA Mayor Droste pulled item 6.c. for discussion. Motion byDeBettignies. Second by Kearney. Bills Listing c. Appointment of SKB Clas3 I Tru3tcc d. On -Sale License on Public Premise e. Special Assessment Agreement (Resolution 2011 -16.) f. Source Water Protection Grant Agreement g. Receive Plans Specifications Ratify Ad for Bid 2011 Street Improvement Project, City Project #432 (Resolution 2011 -17.) h. Approve First Amendment to Amended and Restated MVTA Joint Powers Agreement (Resolution 2011 -18.) i. Lot Split Request by Minnova Land, LLC, Case 11 -02 -LS (Resolution 2011 -19.) j. A Resolution Authorizing Submission of a Minnesota DNR Local Trail Connections Grant and Designating Matching Funds (Resolution 2011 -20.) Ayes: Shoe Corrigan, Droste, Weisensel, Kearney, DeBettignies Nays: None. Absent: 0. Motion carried. 6.c. Appointment of SKB Class I Trustee Mayor Droste gave special recognition to Bill Olson who was present in the audience and formally announced his appointment. Motion by Droste. Second by Weisensel. Motion to approve a resolution to appoint Bill Olson as a Class I Trustee for the SKB Environmental Rosemount Community Trust for a three -year term expiring December 31, 2013. Ayes: Droste, Weisensel, Kearney, DeBettignies, Shoe Corrigan Nays: None. Absent: 0. Motion carried. (Resolution 2011 -21.) 9.a. Amendment to City Code 7-4: Animal Control Police Chief Gary Kalstabakken introduced an ordinance amendment to the animal control ordinance that removes the licensing requirements for cats and also removes language prohibiting cats from being at large. Cat owners will no longer be required to purchase a license for their cat. If complaints are received concerning stray cats, the Police Department will no longer have a Community Service Officer or Police Officer respond to the complaint. Police Chief Kalstabakken stated that the ordinance will still regulate the number of animals permitted at a property, residential or agricultural. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS MARCH 15, 2011 Council member Shoe Corrigan thanked staff for their work and confirmed that the ordinance amendment will be posted on the city website. Mayor confirmed that dogs still need to be licensed through the City and the Police Chief provided instructions on how a resident can accomplish that. Motion by DeBettignies. Second by Kearney. Motion to approve an ordinance amending City Code 7 -4. Ayes: Weisensel, Kearney, DeBettignies, Shoe Corrigan, Droste Nays: None. Absent: 0. Motion carried. (Ordinance 2011 -3) ANNOUNCEMENTS Mayor Droste stated upcoming events on the calendar.
