C, ATTACHMENTS: Draft Ordinance APPROVED BY: RECOMMENDED ACTION: Discussion BACKGROUND: During the spring of each year, it is common for road authorities to establish weight restrictions on roads to prevent damage from the thawing of frost in_the road sub - grade. Up until 2009, Minnesota statutes included a provision that restricted all local streets to a 5 -ton per axle weight limit unless posted otherwise by the road authority. In Rosemount, local streets are built to a 7 -ton per axle design so this restriction was applicable. It was identified this past spring that in 2009, the Legislature amended this section of statute. The amendment included the following changes: • Eliminated automatic reduction in weight limit at 5 -ton per axle. • Established weight limit at 10 -ton per axle for all paved roads. • Added requirement that a local ordinance be adopted to require the establishment of local load limits by resolution. f • Added requirement that streets be posted with signs for the restrictions. Unfortunately there was no clear information communicated in 2009 regarding these amendments. It was only this past year through discussions with neighboring communities that the full effect of these amendments became clear. As noted, the first step is the consideration and adoption of an ordinance to allow for the future establishment of load limits by resolution. Staff has worked with the City attorney's office to develop the attached draft ordinance for Council review and consideration. SUMMARY: Staff is requesting Council review and consideration of the attached draft ordinance. Based on Council feedback, it is anticipated that a final ordinance will be brought before the Council at a future regular meeting for adoption. ORDINANCE RELATING TO LOAD LIMITS ON CITY STREETS, ROADS AND HIGHWAYS; ADDING NEW CITY CODE, SECTION 8 -2 -6 THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS as follows: Section 1. Rosemount City Code is amended by adding new section 8 -2 -6 as follows: 8 -2 -6: LOAD RESTRICTIONS A. Load Restrictions Designated by Council. In accordance with Minnesota Statutes, Sections 169.04 and 169.87, the city council is authorized to impose restrictions on the weight of vehicles operated on highways, roads and streets with the city whenever such highways, roads or streets will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or the permissible weights thereof reduced. To establish such restrictions, the council shall pass a resolution describing and defiling the restrictions and the highways, roads or streets over which they are imposed. B. Restrictions imposed in accordance with paragraph A shall be effective upon the erection and maintenance of signs plainly indicating the restrictions at each end of any portion or portions of the highway, road or street affected thereby. Thereafter, it shall be' ,unlawful for any person to operate a motor vehicle in violation of the restrictions so imposed. r, s Section 2.
