EXECUTIVE SUMMARY
BACKGROUND:
This item is on the agenda to request Payment 3 and Final to Ryan Contracting for the Rosewood Village
3' Addition, City Project 429. The final construction amount of $82,241.15 is 1.5% below the contract
amount of $83,453.30.
This project included the construction of a private street and cul-de -sac with concrete curb and gutter. An
additional private roadway was extended west from the cul-de-sac to provide an emergency access for the
property west of the Rosewood Village 3' Addition. Utility improvements included the construction of
water main, sanitary sewer, and storm sewer.
SUMMARY:
Staff recommends that Council approve Payment 3 and Final for the project and accept the project for
perpetual maintenance subject to the following conditions.
1. Satisfactorily showing that the contractor has complied with the provisions of Minnesota Statutes
290.92 requiring withholding state income tax.
2. Evidence in the form of an affidavit that all claims against the contractor by reasons of the
contract have been fully paid or satisfactorily secured.
3. Consent of Surety to Final Payment certification from the contractor's surety.
4. Two -year maintenance bond.

Please find enclosed the final Construction Pay Voucher No. 3 for the above referenced project in the
amount of $12,019.10.
Also enclosed are the following documents required for processing final payment for the above
referenced project:
1. Satisfactory showing that the contractor has complied with the provisions of Minnesota
Statutes 290.92 requiring withholding state income tax.
2. Evidence in the form of an affidavit that all claims against the contractor by reasons of the
contract have been fully paid or satisfactorily secured.
3. Consent of Surety to Final Payment certification from the contractor's surety.
4. Two -year Maintenance Bond (warranty start date to coincide with the date Council approves
final payment).
We recommend that you make final payment in the amount of $12,019.10 for Ryan Contracting
