APPROVED BY: mil RECOMMENDED ACTION: Motion to Approve the On -Sale Liquor License Class B, Sunday Liquor for Thompsons Fireside Pizza II, Inc. DBA Fireside located at 3410 150 Street West. 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: July 5, 2011 EXECUTIVE SUMMARY ISSUE Thompsons Fireside Pizza II, Inc. DBA Fireside has held an On -Sale Liquor License Class B and Sunday Liquor License since March, 2010. Due to a change in company ownership, it is necessary for Fireside to apply for a new liquor license. Per City Code, in the case of corporate licenses, Section 3 -1 -9A provides that the license is only valid "...so long as there is no change in the officers or ownership interest of the corporation, within the meaning of subsection 3 -1 -6D of this Chapter unless such change is approved by the Council..." From previous documents provided to the City, the applicants only identified the ownership interest of Richard B. Thompson (President and Owner) who owns 60% and Mary Kay Eigner (Vice President and Secretary) owns 40 Since the original application, the applicants submitted documentation that shows a change in ownership. The recitals of the document state that Bradley Erickson is a 19% shareholder of the restaurant. These types of changes in ownership of a corporation must be disclosed and brought before the City Council for approval. Failure to do so is grounds for revocation of the license. The Police Department has conducted the appropriate background check on Mr. Erickson and determined that there are no issues with the background check. Based upon the information provided in the original background investigation of the principles in ownership and the history of the restaurant since opening, it is recommended that a new license with the additional owner be approved. SUMMARY Staff recommends approval of the above stated motion.
