CALL TO ORDER
Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held
on Tuesday, June 7, 2011 at 7:30 p.m. in the Council Chambers of City Hall at 2875 145`" Street
West, Rosemount, Minnesota.
Mayor Droste called the meeting to order with Council Members DeBettignies, Shoe Corrigan,
Weisensel and Kearney attending. Staff present included City Administrator Johnson, City Clerk
Domeier, Community Development Director Lindquist, Communications Coordinator Cox, Police
Chief Kalstabakken, Director of Public Works /City Engineer Brotzler, Police Officer Waage, Police
Officer Trefethren, Police Officer Risvold, Police Sergeant Sommers, Police Officer McMenomy,
Police Officer Geske and City Attorney Tietjen. The Pledge of Allegiance was said.
PUBLIC COMMENT
Diane Wellman, 2051 145 Street East, Rosemount, provided information on the golf tourney and
food drive as part of Leprechaun Days.
Jim Sample, 4450 138 Court West, Rosemount, followed -up on a letter he sent to the City Council
regarding various water issues at his property. Mayor Droste invited Mr. Sample to the June 15 work
session where the issue would be discussed.

NEW BUSINESS
9.a. Home Occupation Ordinance Text Amendment: Prohibiting Body Art (Tattoos and
Body Piercing) Establishments, Case 11 -03 -TA
Community Development Director summarized the information provided in the staff report. Staff
recommendation was to approve a Zoning Ordinance Amendment Prohibiting Body Art
Establishments as Home Occupations.
Council Member Kearney questioned the other uses that are not permitted as home occupations.
Ms. Lindquist replied that if businesses cannot comply with the standards laid out in the zoning
ordinance they cannot be a home occupation. Those businesses typically include any auto related
types of uses, landscaping and building companies where there is exterior storage. Council Member
Kearney questioned the number of complaints received for tattoo establishments as home
occupations. Ms. Lindquist replied that no complaints have been received and that currently there
are no technicians operating out of their homes. She added that the change in the City ordinance
for licensing prompted the discussions of where the establishments were permitted. Council
Member Kearney also questioned the inspection process. Ms. Lindquist explained that the City may
be involved in the enforcement process related to zoning issues. The State would handle the heath
issues. Council Member Kearney questioned why staff believes the State won't enforce the law. Ms.
Lindquist shared concerns about other enforcement issues where the State issues the licenses.
Mayor Droste and Council Member Shoe Corrigan shared concerns about the health and sanitation
issues. Council Member DeBettignies was concerned with the inspections only occurring every
three years. Council Member Kearney questioned how the issue was any different than operating a
daycare with the amount of traffic and inspections required. Council Member Weisensel was
concerned about the number of phone calls that will be made to the City about issues.
Council Member Kearney stated his concerns on making a determination on what businesses are
allowed in homes. Council Member Shoe Corrigan stated that land use and zoning issues fall upon
the City Council to make policy decisions.
Motion by Shoe Corrigan. Second by Weisensel.
Motion to Approve the Zoning Ordinance Amendment Prohibiting Body Art
Establishments as Home Occupations.
Ayes: Shoe Corrigan, Droste, Weisensel, DeBettignies

ANNOUCEMENTS
Mayor Droste reviewed the calendar of events. The next City Council meeting will be held on
Tuesday, June 21, 2011. The Youth Commission will meet at 1 p.m. on Wednesday, June 15, 2011.
ADJOURNMENT
There being no further business to come before the City Council and upon a motion by Droste,
second by DeBettignies, the meeting was unanimously adjourned at 8:33 p.m.
