RECOMMENDED ACTION: Motion to adopt a resolution approving the liquor license
amendment of the On -Sale Class B Liquor License for Thompsons Fireside Pizza II, Inc.
DBA Fireside located at 3410 150th Street West to allow for outdoor liquor service in the
tent area adjacent to building) on Saturday, August 14, 2010, subject to conditions.
ISSUE
Fireside is planning to hold the Hockey Rocks the Pond event in conjunction with The Pond on Saturday,
August 14. The event will be held inside The Pond ice rink and outside in the parking lot adjacent to
Fireside. Fireside Pizza's bar and restaurant will also be open during the event. The main event is a GB
Leighton Concert in the tent in the evening. Ms. Kadie Johnson, Fireside's General Manager, initially
requested that liquor service be extended into a fenced tent area immediately adjacent to the entrance of
Fireside from 5:00 p.m. —11:00 p.m. Staff supports the event but recommends that the outdoor event and
service of alcohol end at 10:00 p.m. While the Leprechaun Days at Central Park end at 11:00 p.m., staff
believes this event is different in nature due to its proximity to residential homes and is not part of a City
festival. Staff believes 10:00 p.m. is consistent with other hours of noise regulation, specifically
construction hours are limited to no later than 10:00 p.m. (actually construction is 7:00 p.m. on Saturday
and Sunday).
The current On -Sale Class B Liquor License issued to Fireside only includes the restaurant as its premise.
Liquor licenses are only valid in the compact and contiguous building or structure situated on the premise.
The license may be extended to an outdoor deck or patio area provided the specific criteria in City Code is
met by the licensee and approved by City Council. Further, City Code Chapter 3 -1 -12, Subdivision C
states that is unlawful for any person to consume intoxicating liquor or 3.2 percent malt liquor or have in
his possession any bottle or receptacle containing intoxicating liquor or 3.2 percent malt liquor which is
open while in the parking area of any shopping center or other commercial establishment. Ms. Johnson is
proposing an additional area for liquor service as depicted on the site plan which is not part of the licensed
premise. Because of the nature of the request, a liquor license amendment with City Council approval is
required to allow for the sale of alcohol in the tent outside of the currently licensed premise.
Since a formal process for applying for outdoor events involving music and /or liquor service has not been
fully developed in the City Code, staff met with the Fireside representatives to ensure that compliance with
existing liquor and safety requirements were met and that noise regulations were addressed. The Police
Department is aware of the event and will respond to any reported noise complaints. Staff is considering
creating an ordinance to address future outdoor events.
The property owner, Ron Carlson, and his management company are aware and supportive of the
Fireside /Pond event and its use of a portion of the Rosemount Market Square parking lot. The proposed
location of the tent and security fencing will separate the parking lot into two. Staff is supportive of this
layout provided that a twelve (12) foot emergency vehicle access is maintained throughout the parking lot.
Fireside /Pond has stated that they will provided a twelve (12) foot separation between the double security
fence on the west side of the tent and their security staff can open the outer security fence if an emergency
vehicle needs to access the entire site. A building permit and an electrical permit are required. A detailed
site and floor plan shall be provided with the application. The permits must be issued before inspection
and occupancy of the tents.
Fence will extend from building entrance and enclose the entire tent area. It will be a double fence around
the tent area to provide a buffer between the extended area and the parking lot. Double fencing will allow
security staff to move freely around the fenced area and limit the possibility of alcoholic beverages being
passed outside the permitted area. Fireside will ensure that all entrances are staffed by personnel to
monitor access.
There is one related issue of rear emergency exit to The Pond space. A permanent stairs has not been
installed at the rear exit to The Pond. A building permit has been applied for the stair but the construction
has not yet commenced. A condition within this liquor license extension is that the stairs be completed
and inspected by the Friday before their event.
RECOMMENDATION
Information detailing the outdoor events taking place during the day and evening has been submitted to
staff along with the request for the extension of liquor service. Based upon the information submitted,
staff supports the extension of the service of alcohol with the condition that alcohol is allowed in the tent
between the hours of 5:00 -10:00 p.m. on Saturday, August 14.

A RESOLUTION APPROVING THE LIQUOR LICENSE AMENDMENT
OF THE ON -SALE CLASS B LIQUOR LICENSE FOR THOMPSONS FIRESIDE PIZZA II, INC.
DBA FIRESIDE LOCATED AT 3410 150TH STREET WEST TO ALLOW FOR OUTDOOR
LIQUOR SERVICE IN THE TENT AREA (ADJACENT TO BUILDING) ON SATURDAY,
AUGUST 14, 2010
WHEREAS, Thompsons Fireside Pizza I1, Inc. DBA Fireside submitted a request to amend its current On-
Sale Liquor License Class B and Sunday Liquor License for Fireside located at 3410 150th Street West;
WHEREAS, the request was to extend the licensed premises for Fireside to include the sale of liquor in
outdoor tent area on the north side of the building on August 14, 2010;
WHEREAS, an additional request was made to include a live music event in same tent on the north side of
the building on August 14, 2010; and
THEREFORE, BE IT RESOLVED, that the City Council hereby approves the extension of licensed
premises to include an outdoor tent at 3410 150th Street West subject to the following conditions:
1) The licensee will begin the sale of alcohol and event of live music no earlier than five o'clock
(5:00) p.m. and end no later than ten o'clock (10:100) p.m. on Saturday, August 14, 2010;
2) The licensee will clear the tent and all parts of the outside service area of all patrons no later ten -
thirty o'clock (10:30) p.m. on Saturday, August 14, 2010;
3) Maintain the minimum of a twelve (12) foot wide emergency vehicle access through the
Rosemount Market Square parking lot;
4) A building permit and an electrical permit are required. A detailed site and floor plan shall be
provided with the application. The permits must be issued before inspection and occupancy of
the tents;
5) Completion and final inspection of the rear stairs for The Pond by 4:30 p.m. Friday, August 13,
2010; and
6) Compliance with narrative, tent floor plan, and parking lot layout provided on July 14, 2010.
ADOPTED this 20th day of July, 2010 by the City Council of the City of Rosemount.

Security: There will be 6 individuals hired for the concert hours of 5:OOpm- 10:OOpm. Two will
be at the door, two near the music and two roaming. One main contact will be in charge
throughout the entire day. In addition to the hired security, we will also have volunteers
assisting with checking proper identification at the doors for wristband purchase.
Electrical Plan: Titan Energy will be providing us with a generator that will be placed in the
South corner of the parking lot closest to 42. This will provide all power necessary for lighting,
music, vending equipment, etc.
Food and Beverage: Food and beverage will be served from 12:00- 10:OOpm. All hot food will
be held in food warmers and chafing dishes. All cold food and beverage will be in the
refrigerated truck provided by A Taylor. Food will be temperature controlled in compliance
with current health codes. Beverage will be on ice if out of the truck. Alcoholic beverages will
be provided by Phillips Wine and Spirits, A Taylor and Coca -Cola and sold through Fireside's
food and liquor license. Appropriate measures will be taken to see that we are only serving of
age guests and not over serving to a point of intoxication. Proper identification will be required
for wrist band purchase.
Signage: A banner will be placed in the ground near the current mall monument sign, north of
the front doors of Fireside and The Pond. Appropriate signage for entrances and exits will be
posted.
Restrooms: On -Site Sanitation will provide 6 restrooms for outside of the tent.
Ticket Sales: Ticket's for the professional 3 on 3 games and the GB Leighton concert will be for
sale at Fireside Bar and Restaurant. Concert tickets will only be sold to persons 21 and up.
Proper identification will be required at time of purchase. Identification will be again needed at
the gate the night of the concert.

Parking: No parking will be allowed on 42. Our lot in conjunction with the adjacent lots will
provide ample parking.
Volunteers: Each area will have one volunteer director over seeing volunteer groups.
Emergencies: A 12' area around the tent will be allotted to provide access for emergency
vehicles. See parking lot layout for details.
