Administrator ATTACHMENTS: None APPROVED BY: RECOMMENDED ACTION: Motion to Approve the Labor Agreement for the LELS Local #223 Supervisory Collective Bargaining Unit for the Years 2010 through 2011 and to Authorize the Necessary Signatures. ISSUE The City of Rosemount and LELS Local #223 (Police Sergeants) have negotiated in good -faith and have come to a tentative agreement. BACKGROUND Negotiations with the Law Enforcement Labor Services, Local #223, have been completed for a 2010 through 2011 contract. The Collective Bargaining Unit and City have reached a tentative agreement on the following items: Clarify: 1. ARTICLE 20 — VEBA /HSA CONTRIBUTION (Clarifying Language) The Employer shall contribute $530 into the employee's VEBA or LISA account in January of the Plan year. Employees hired after January 31 will receive a prorated amount. This contribution shall cease at the time that the City no longer participates in the VEBA #830 Plan or HSA Platis. 2. ARTICLE 26 — SEVERANCE PAY (Clarifying Language) Regular full-time employees leaving the service of the EMPLOYER in good standing for any reason other than retirement and with two (2) weeks' advance notice will receive payment at the employee's rate at time of leaving the employ, as prescribed below: Vacation: Up to accrual ;qza_%i&nrrj! Comb Time: Lip to ciccrrral mairnrrna Plus: 0 -5 years 15% of accumulated sick leave 6 -10 years 30% of accumulated sick leave 11 -15 years 45% of accumulated sick leave 16 years and over 60% of accumulated sick leave 3. ARTICLE 27 - RETIREMENT PAY (Clarifying Language) Regular full-time employees who leave the City's employ to accept a retirement annuity will receive payment at the employee's rate at time of retirement as prescribed below: Vacation: Up to accrual l area infirm Comm Time: 14P to accrual tvg.%- r&vt#a Plus: 0 -5 years 15% of accumulated sick leave + 2 weeks' pay 6 -10 years 30% of accumulated sick leave + 2 weeks' pay 11 -15 years 45% of accumulated sick leave + 4 weeks' pay 16 years & over 60% of accumulated sick leave + 4 weeks' pay 4. Appendix A —Wages 2010: 1.5% on January 1 2011: 1.5% on January 1 5. Memorandum of Understanding (MOUs): MOUs: Eliminate the VEBA Health Care Reimbursement Arrangement memo dated 1 -1 -08 and amend the Post Retirement Health Care Savings Plan memo dated 1 -1 -08. The net effect will change the $100 per pay period employee contribution to go into the employee's MSRS accounts rather than into their VEBA accounts. The Sergeants already have accounts set up so that their eligible retirement pay goes into their MSRS accounts. • Eliminate Memo of Understanding (MOU) 1/1/08 — VEBA Health Care Reimbursement Arrangement: Eliminate memo which allows the employees to contribute additional contribution towards their VEBA accounts. The Supervisors currently contribute an additional $100 per paycheck. • Amend Memo of Understanding (MOU) — Post Retirement Health Care Savings: Clarify language regarding a Post Retirement Health Savings Account under the Minnesota State Retirement System (MSRS). Employees currently have their accounts set up to roll their eligible retirement pay into the account. Add language to allow them to contribute $100 per pay period to the Employee's account in the MSRS Post Retirement Health Care Savings Plan. SUMMARY This month, LELS Local #223 voted and approved these contract changes. None of the language clarifications have any economic impact on the City other than the wage increases. It is requested that Council approve the labor agreement for the LELS Local #223 Collective Bargaining Unit for the years 2010 through 2011 and to authorize the necessary signatures.
