City Council Regular Meeting December 7, 2010
BACKGROUND
Councilmember Kurt Bills was elected to the Minnesota Legislature on November 2nd. His term of office
on the City Council does not expire until December 31, 2012. Under state statutes, the City Council must
appoint someone to complete Mr. Bill's term on the City Council. At the November 10th council work
session, the Council directed staff to propose procedures for the appointment of a new council member.
The person appointed must be a resident of Rosemount for at least 30 days, entitled to vote, and be at
least 21 years of age under Article VII, Section 6 of the Minnesota Constitution.
Compensation for a council member in 2011 is $6,396.30 per year.
PROPOSED PROCEDURE AND TIMELINE
The proposed procedure below follows the City's adopted policy for the selection of Commission
members as closely as possible.
Advertise for Applications: December 7 to December 30, 2010
The position would be advertised through news releases to each newspaper of circulation in
Rosemount; the City's website, cable TV station, weekly electronic updates, and Facebook page; and
also posted in City Hall.
All candidates would be required to fill out an application form (attached) and send it to the City Clerk
by email, fax, or regular mail so that it is received by the City Clerk by 4:30 p.m. on December 30,
2010. The City Clerk can be reached by email at amp .,domeier&ci.rosemount.mn.us, by fax at 651-
423 -4424, or by mail at 2875 145th Street West, Rosemount, MN 55068. Candidates may also submit
a resume, but this is not required.
Interviews: January 11 and 12, 2011
Interviews will be scheduled on one or both of these dates, depending on the number of candidates
who apply. Questions will be determined by the council members. Approximately 45 minutes will be
scheduled for each interview. If second interviews are needed with one or more candidates, the
Council will determine an additional date for interviews.

RECOMMENDED ACTION: Motion to accept the resignation of Kurt Bills from the City
Council effective December 22, 2010 and to adopt a procedure to fill the pending vacancy.

Selection: Mid February
A majority vote of the Council is necessary for the appointment. If the Council is tied, the statutes
provide that the Mayor shall then appoint.
OATH OF OFFICE AND ORIENTATION
The selected candidate will take the oath of office and be officially installed as a member of the City
Council at the next meeting of the Council. Staff will update and provide standard orientation materials
for the new member once selected.
RECOMMENDATION
The Council is requested formally accept the resignation of Council Member Kurt Bills, review the
proposed procedures and timelines, and adopt them after making any changes desired.

Minnesota Statutes Chapter 412.02
Subd. 2a.Vacancy.
Except as otherwise provided in subdivision 2b, a vacancy in an office shall be filled
by council appointment until an election is held as provided in this subdivision. In case of
a tie vote in the council, the mayor shall make the appointment. If the vacancy occurs
before the first day to file affidavits of candidacy for the next regular city election and
more than two years remain in the unexpired term, a special election shall be held at or
before the next regular city election and the appointed person shall serve until the
qualification of a successor elected at a special election to fill the unexpired portion of the
term. If the vacancy occurs on or after the first day to file affidavits of candidacy for the
regular city election or when less than two years remain in the unexpired term, there need
not be a special election to fill the vacancy and the appointed person shall serve until the
qualification of a successor. The council must specify by ordinance under what
circumstances it will hold a special election to fill a vacancy other than a special election
held at the same time as the regular city election.
