Application for On-Sale Liquor License Class B, TOPS Pizza & Hoagies4ROSEMOUNTEXECUTIVE SUMMARY CITY COUNCIL City Council Regular Meeting: December 7, 2010 AGENDA ITEM: Application for On -Sale Liquor License AGENDA SECTION: Class B, TOPS Pizza & Hoagies Public Hearing PREPARED BY: Amy Domeier, City Clerk AGENDA NO.0 ATTACHMENTS: None APPROVED BY: RECOMMENDED ACTION: Motion to Approve the On -Sale Liquor License Class B for TOPS Pizza & Hoagies for the premise located at 14533 Dodd Blvd. SUMMARY Markos and Steven Chouliaris have submitted an Application for an On -Sale Liquor License Class B for TOP Pizza & Hoagies located at 14533 Dodd Blvd. For over 15 years, Markos Chouliaris has held an On- Sale Wine including Strong Beer, 3.2% Liquor and Sunday Liquor License in Rosemount. The applicants applied for the full on -sale license because of an expansion made to their establishment. The application was accompanied by the necessary liquor liability insurance, workers compensation insurance, and investigation fees. A copy of the lease was not required as the applicant owns the premise to be licensed. Per City Code, Class B liquor licenses may only be issued to hotel and restaurants where fifty -one percent (510/6) or more of total revenues are derived from the sale of food and nonalcoholic beverages for consumption on the premises during hours when the sale of alcoholic beverages is allowed. During the liquor renewal process in 2011, the applicants will be required to submit a statement signed by an independent certified public accountant attesting that 51% or more of the total revenues were derived from the sale of food and nonalcoholic beverages for the preceding 12 months. The Police Department conducted a background check of the applicants. There were no violations of liquor laws found to have occurred at the establishment. Based upon information learned in the background investigation, staff does not believe the license should be denied. RECOMMENDATION Upon holding the public hearing, Staff recommends approval of a Motion to Approve the On -Sale Liquor License Class B for TOPS Pizza & Hoagies for the premise located at 14533 Dodd Blvd.
